Officer in Costco shooting says man raised gun, didn’t know it was in holster

This comes from a Vegas paper, so I'll summarize:

Day 1 of the inquest into the police shooting of Eric Scott at a Las Vegas Costco emphasized the large amount of prescription painkillers found in his body. The assistant DA suggested Scott was suicidal.

Day 2 apparently spent a bunch of time explaining why there will be no video...basically, the machines weren't working, sorry.

Then the cop who was closest to Scott testified. In his testimony, he says the gun found by investigators was in its holster, and that he didn't realize the gun was in its holster when he shot Scott. That info comes about 2/3 of the way into the article:

Maybe it would help clarify things if those asking question could peruse this site & look at pictures of the guy police say is a drooling, morphine addled would-be cop killer.

I know heavy amounts of painkilling drugs were found in his body, and his family and doctors agree he was using them.

Mr Scott is being accused of pointing his weapon at a dog AND the dog's owner four months prior.

The second day of testimony has begun in the coroner's inquest into the Metro Police shooting death of Erik Scott on July 10 at the Summerlin Costco.

The first person to testify is Steven Novotny, who alleges Scott pulled a gun on his dog on March 9 this year. Novotny said the dog had bitten Scott.

"Mr. Scott said 'you're lucky I didn't shoot you and your (expletive) dog,'" Novotny testified.

Novotny said Scott was pointing his gun at Novotny when the incident occurred.

Looks like a standup guy. I'm not a bootlicker or a cop hater. I think most do a good job under shitty circumstances but after Ruby Ridge and Waco I take every case by itself.

The fact that Costco admitted that they had a tape and would release it to the family attorney and then said that the machine was broken is troubling.

The fact that there are many eye witnesses whose sworn testimony conflict with the police is troubling.

I would like to know what kind of gun he had and what kind of holster it was in.

Most cops go through their entire career and never discharge their weapon.

Officer Mosher has shot three people in five years. Scott is the second one he's killed.

Just tossing that out there, too.

I see this kind of stupid stereotype on FR everytime people disagree on ANY subject. There are people on this thread that have cops in their families. They are not "anti-cop".

You still have not answered whether you have read all the articles on this. I have as have several others. We have a different opinion on this than you. That does NOT make us anti-cop.

Btw, you REALLY need to talk to some Las Vegas freepers about their PD. Truly frightening.

Sounds like Scott was attacked by the dog and pulled his firearm in defense and the owner got the dog under control. Not enough info to form an opinion

It would make a difference if the dog was a Jack Russel or a pit bull.

Hard on him? They dropped him with six or seven shots.

Ideally, he would have been tackled by the three officers rather than terminated, but the radio message that he was handling a gun in the store, was acting erratic, was mumbling and removing steel bottles from their containers and appeared 'drugged up' ... if you're going to draw down on someone, draw enough caliber to put them down in one or two center mass shots.

Two officers fired from behind the man after or as the officer in front fired two rounds. People all over the place around the officers ... too easy to have collateral injuries from officer misses or perp shots gone astray.

Did any of the three have a non-lethal option that they could employ immediately? I don't see anything on that in all the media released material and articles.

A trasgic death has happened. A poorly handled situation is what we see now, with the media spin and hate mongering from a peanut gallery of cop haters, but in the moments of the events, sorry, I would have dropped this guy as the best alternative when I saw him take weapon in hand. Only I would have made a head shot to try and end the confrontation instantly.

All of that said, the officers in question should possibly be removed from any possible future armed confrontations, as a precaution. There are plenty of support jobs in law enforcement which don't require a weapon on the person. Yeah, I've seen even dispatchers sometimes have a holstered weapon, but not all and not by department requirements.

Bottom line? ... There is no bottom to the feeding frenzy as several posters are demonstrating, including smartass insults to longtime Freepers. A feeding frenzy is seldom pretty don'tchaknow.

Actually, neither the cop nor the employees apparently saw the holster until it was on the ground with the gun in it. That means they were seeing what they expected to see rather than what was in front of them - a very common occurrence, according the the folks that taught the USAF Safety School at USC.

It also leaves the fact that it WAS in the holster, and most IWB holsters I’ve seen don’t give access to the trigger - wearing in the pants, it is important that the trigger be protected.

“The Costco security person testified that Scott separated from his girlfriend, stumbled while he walked, and touched his gun several times. He also reported that he reached for his gun when the first officer approached him, but hadn’t pulled it out yet.”

I don’t know it from personal experience, but I’ve read touching the gun is both common and an easy way to tell someone is carrying a gun. I do the same to my wallet in an airport - check to see it is there. It is considered a bad habit by most CCW folks, but lots do it.

“Was Rush on potentially lethal levels of Xanax as well as pain killers? Was Rush also being a hypocrite and liar at the time?”

Beats me - but Rush was on very high levels of painkillers and talking sensibly for 15 hours a week in front of 20 million listeners. From that I deduce that high levels of painkillers does NOT cause suicidal thoughts or freakish behavior from those using them. My wife, an RN, tells me she has patients that take levels of drugs that would kill her in a heartbeat.

Spare me the sob story. I’ve been called a “bootlicker” a dozen times, and you call me out for an “anti-cop” stereotype?

I’ve known men that were gunned-down in the line of duty in standoffs that started like this. It is unwise for cops to underestimate the threat posed by an armed, apparently drugged, individual that was erratic enough to have the cops called on him.
