They are prevented from asking a couple of quick questions to ascertain the situation?

More proof of why the “reasonable man standard” no longer works. There are so few of us “reasonable men” left...


an what questions should this be? excuse me sir are you a criminal or do you have criminal record yes/no?
are you in personal allowed to open carry because of this yes/no?...
they have been within their rights to ask for an ID in this case. Because how in this world should a police officer fullfill his job if she/he has no chance to verify what you might say? i mean serious what would be next. sorry sir but we stopped you because the car you are driving looks exactly like the car which has just been stolen one block away. so is this your car? btw. do you have a driver license? (of course there is no need to show it because if you say yes all the time i believe you so there is no need to check it... ;-)

Also, stop using the driver's license analogy. It doesn't fit. Driving is not a Constitutionally protected Right. That is a separate argument.
