TIMES RECORD • ASHERRILL@SWTIMES.COM | 2 comments

Drug investigators entered the wrong house while trying to serve a search warrant last week.

Investigators from the Sebastian County Sheriff's Office, the 12th/21st Judicial Drug Task Force and the Barling Police Department had the homeowners handcuffed by the time they realized the mistake, said Capt. Kevin Nickson.

All the paperwork for the search warrant was correct, said Prosecuting Attorney Dan Shue.

The night-time search warrant was to be executed at a Holly Avenue residence, according to court records. Instead, authorities entered another home on Holly Avenue where a man, woman and baby who are "law-abiding citizens" live, authorities said.

Authorities said the door to the residence was unlocked, and they opened it and walked in.

Investigator Cpl. Anthony Sacco was out checking the address on the mailbox as other investigators entered the house. Once inside, Sacco alerted Nickson, who also was there, about the mistake.

The man and woman were not arrested and handcuffs were taken off them. A baby was also present, but was asleep the entire time.

"You can't apologize enough for a screwup like that," Nickson said.

While it was a Drug Task Force case, the majority of law enforcement officers were from the Sheriff's Office.

The protocol normally followed before executing a search warrant calls for investigators to scout out the location prior to the search. That was not done in this case. "That's the kind of mistakes we can't afford to make," Nickson said.

Investigators later served the search warrant on a nearby house, where they arrested three people and recovered marijuana from the residence, said Nickson.

Used to be an IRS confiscation agent around here. He seized a building, locked it up, and refuse admittance to a young mother whose baby was still inside.

IRS fired him.

They have their limits! Kidnapping babies is one of those things NOT on their agenda. (Bwahahahahaha).

LOL....though I live behind another house, a six foot block wall, have a 120 pound dog that doesn't like intruders in his domain, I still keep the screen door and main door locked.

I figure if that door is breached, whatever comes through it is going to get blasted, I'll take my chances in court.

Happened to my Mother and her Husband while they were babysitting for my sister. To bad they didn’t kill my pedophile step dad. But they sure had their chance.

The buck shot used to breach the door missed him by inches.

4th amendment? Waz dat?

G_d forbid they try to kick in MS13's back door. They fight back.

Crime doesn't pay.//// Taxpayers do!

What a bummer for the cops. They didn’t even get to shoot any dogs.

Every officer involved should be charged with illegal entry, kidnapping, possession of a firearm during the commission of a felony, explosives charges and anything else a really overly enthusiastic prosecutor would think of.

Make the officers personally responsible, and I guarantee that the number of these drops way down to effectively zero. The fact that each officer is personally checking the address three times would help ensure it.

“man, woman and baby who are “law-abiding citizens” live, authorities said.”

Why is this phrase in quotes? It just seems odd....

Good thing they didn’t have a dog. Or they’d have a dead dog now.
