First doctors group sue to overturn health care act

It looks as if it is not just state attorneys general that are filing a lawsuit against the new health care law recently passed by the Democrats and signed into law by President Obama. The Association of American Physicians and Surgeons (AAPS) put out the following statement:

The Association of American Physicians and Surgeons (AAPS) became the first medical society to sue to overturn the newly enacted health care bill, the Patient Protection and Affordable Care Act (PPACA). AAPS sued Friday in the U.S. District Court for the District of Columbia (AAPS v. Sebelius et al.).

I’m sure Obama will consider this a credible complaint, he did say “You are the people (doctors) who know this system best. You are the experts. Nobody has more credibility with the American people on this issue than you do.”

Oh wait, he must have only been talking to the doctors that agreed with him!

It didn’t say what grounds they were suing on. Obviously, there are many available, but it would be interesting to
know more detail.

Good news.

The constitution doesn't uphold itself - must be a challenge to the law for them to rule. The more that take this on the better.

Is anything happening with any of the State AG lawsuits or private lawsuits that have been filed against 0bozoDeathCare? I was hoping that SCOTUS would have the balls to put this on an expedited schedule, before the taxes & add’l bureaucracies start to kick in and then take on a life of their. Personally I think that secession by 8-10 core Southern & Western states will be needed in order to stand up & stand opposed to 0bozoDeathCare. And hopefully another 8-10 states will then join the secession as well.

I’m looking into the possibility of getting a religious exemption for every prolifer in the country. The exemption language attempts to limit exemptions to a few, specific religious groups, probably because they have a long history (50+ years) of conscientious objection on other issues.

However, showing preference toward one religion to the exclusion of others is a classic case of de facto establishment of a religion, thus invoking an Establishment Clause violation. Standing would be immediate, because taxpayer standing, while denied in almost every other kind of case, is available in the right kind of Establishment Clause case. The exception fits.

Therefore, they can’t restrict it to Amish, Christian Science, etc., but would have to allow anyone with a demonstrable conviction that they cannot fund the murder of the unborn, which this bill certainly can be shown to require.

And if about half the country is prolife, and if we all opt out, the little boat called Obamacare loses all it’s fuel and under its own weight sinks forever out of sight.

Just a thought. And I’m thinking it could be a class action setup. We could get millions of people signed on. It could be the best kind of fun.

These docs better be careful...I see IRS audits in their future...I wonder if their organization could be considered a right Wing militia group, afterall they use sharp knives and have access to dangerous gasses in bottles
