The EPA cannot afford to let this go to court. The discovery process may be damaging to the EPA’s powers in other areas. Rather than allow that, the may drop CO2 regulation in order to make the case moot.

Not to worry. This is a gift from Gaia, who has been feeling dissed lately... Peabody has very deep pockets and can hire a lot better lawyers than the EPA has.
I especially like that they will demand discovery not only of all the released email and data so far, but everything else the fraudsters have conjured up. Everything will be admissible, the perps will be deposed under oath, and called to testify.
The potential for criminal referrals abound. Let us hope Peabody has a streak of vindictiveness at work, and intends to fry these rat-bastards in their own sauce.

It would seem appropriate, to explain the mechanical causes of this statement....what are the reasons for increased major hurricanes, large sized hail...etc...the writers make these profound statements, but fail to justify....

He can, however, be held to account for racketeering and fraud, exploiting the moneyed naive, based entirely on the unfounded assumption, and the fraudulent "proof" that anthropogenic warming both exists and can be controlled by any measures modern mankind may adopt.
That global warming exists has always been beyond dispute, since the Earth is not yet a dead planet. It is also beyond dispute that warming and cooling is a natural alternating process that has been ongoing for hundreds of thousands, and millions of years.
I think we must kick the fraudsters while they're down, so they don't even think about repeating their "tricks" in the name of Science.
Another major suit by taxpayers is absolutely necessary, both to establish the fraud beyond dispute, and to remove the onerous laws and monumental taxes that have been imposed in the name of "gobal warming."
No one has more "standing" than the American taxpayer, who bears all of the direct as well as the indirect taxes, fees and loss of liberties.

The immediate reaction for leftist will be dismissal because its evil coal. But in reality, who else is going to challenge it. Is someone with no bone at all in the fight going to challenge it? Anybody else would have their case dismissed because they had no "standing".
