RICHMOND, Va. (AP) - Virginia's attorney general is challenging the federal government's conclusion that greenhouse gases are dangerous to people.
Attorney General Kenneth T. Cuccinelli II said Tuesday he has asked the Environmental Protection to delay final consideration of that finding so "newly available information" can be reviewed.
Cuccinelli did not elaborate on that new information and did not immediately respond to an interview request from The Associated Press. He scheduled a news conference for Wednesday.
Cuccinelli also said he would seek a legal challenge of the EPA's finding, which would regulate greenhouse gases under the Clean Air Act.
Virginia's actions are aimed at a December EPA "endangerment" finding about carbon dioxide and other greenhouse gases, setting the stage for future rules restricting such emissions.
A spokeswoman for Gov. Bob McDonnell said Cuccinelli "is acting in the best interests of the citizens of Virginia."
"The current federal position could have a negative impact on job creation and economic development in the commonwealth and should be reconsidered," the spokeswoman, Stacey Johnson, wrote in an e-mail to the AP.
The Sierra Club criticized the challenge, calling it a waste of taxpayers' money.
"Cuccinelli is embarrassing the citizens of Virginia at the taxpayers' expense," said Glen Besa, director of the Virginia chapter of the environmental group.
Virginia joined Texas in challenging the EPA, saying the agency's finding was based on flawed science.
The U.S. Supreme Court declared in 2007 that carbon dioxide and other greenhouse gases are pollutants that the EPA could regulate if found to endanger public health. The Bush administration never acted on the court order.

Reminiscent of George Allen’s tenure as governor. He, too, told the EPA to stick it in their ear regarding an attempted government takeover of automobile emission inspection stations. Allen was successful in keeping them in private hands and at your local gas station.

It isnt the laws that get you, but the regulations.
Laws are written by the Legislature, You can go to the Legislature and ask that a law be changed, thats it is wrong, that it should not be passed.
Regulations are written by some bubble headed bureaucrat who belives he is much smarter than all the rest of us, They make up the regulations and there is nothing we can do about it.If we dont like that regulation, they will make up some more.Regulations are laws made by fiat.
Obama ordered the EPA to pass this regulation because his cap and trade bill wasnt getting passed. The man who sits in the Oval office thinks he is a King.
The enviro freaks are false-prophets of a cult-like religion. The citizens have awoken due to the recent display that GW is a fraud and will now tar and feather these goons.
I think that Glen is an embarrassment to responsible environmentalism. Glen cannot support his assertions with science and facts so he pretends that carbon dioxide is really a dangerous greenhouse gas. CO2 is not. Look at the science and the facts, Glen.
It could end up in a lawsuit. I believe that’s how George Allen prevailed.
In Florida, we got rid of them all together, maybe Virginia should take a hint. The emissions checks were of some minor value before virtually all vehicles were equipped with computer controlled fuel injection. If there is a problem with the system or one of its sensors, that little light comes on the dash to let you know it needs looking into.
Interesting...in Virginia, we just waved good-bye to the DNC chairman who moon-lighted as the governor. Now, we’re finally beginning to return to our roots of Jefferson, Monroe, and Washington (George, that is).

The "old" information should be sufficient to exonerate CO2, nothing new required.
Simply display the chart that shows, via ice core samples, that the increase in atmospheric CO2 FOLLOWS temperature increases throughout history. Or perhaps point out that , of the roughly one degree centigrade increase in temp during the twentieth century, three-fourths of that increase occurred prior to 1940. Show the recent correlations between solar activity and temperature, the fact that other planets in our system are warming.
New information would be welcome, but shouldn't be necessary.
In the 3 minutes that I took me to read this post I have exhaled several liters of co2 into the atmosphere. ...therefore by EPA standards I am a dangerous emitter that needs regulation. ..
I wonder if Mr. Besa would be willing to publish the statistics showing how many humans die each year from CO2 poisoning?
I do believe I may be proud of my state again very soon.
