Gee, they re-wrote the law to make sure Romney couldn’t appoint a senator then they re-wrote the law again to make sure Patrick didn’t have to live by the law they passed for Romney. Why wouldn’t the GOP think the Dems would try to stall seating a Republican senator?
If Brown wins, the first thing he should do is seek a restraining order against the Senate in every jurisdiction where it might possibly apply, preventing any further votes by Sen. Kirk from being legally binding.
No, whoever wins next Tuesday fills the remainder of the Kennedy term. Next election in 2012.
Look for the Democrats to not wait that long.
If the GOP retakes the Senate by 1 seat, the Democrats will scream about a "power sharing" arrangement like they had negotiated with Trent Lott back in 2001 when the Senate was tied at 50-50 with the VP breaking the tie for the Republicans.
Remember too that when Jim Jeffords switched to the Democrats, all talk of power sharing was gone.
However, the GOP are suckers for being sweet-talked to their disadvantage.

I spoke with someone in Brown’s office today and brought this up. He alluded to the fact that there are attornies in place to deal with anything unseemly.
