Investigators said they received several tips directing deputies to check the house at 5702 Citadel Drive. Officers went to the house once, but were told the man wasn't home. They were called back to get a DNA sample voluntarily.

The two men they received samples from were Morales-Marin, 23, and 24-year-old Juan Hernandez-Monzalvo.

When investigators arrived at the home to collect DNA samples, they said Morales-Marin had bags packed in his car, so they had an immigration hold put on him.

A DNA sample from Morales-Marin matched the DNA found on the rape victim, police said. The DNA also matches a rape that happened near the Florida Mall in January 2008.

The victim in that incident was 19 years old and pregnant. Investigators said she was picked up by two Hispanic men in a black car. "She was at the Florida Mall, black vehicle picked her up, they drove her behind a group of businesses back there and sexually battered her. She called law enforcement. We responded out. Transported her out to the hospital and got her into the sexual assault treatment center where she was treated and evidence was collected," Mankewich said said.

The 19-year-old said he drove her behind some nearby buildings and raped her several times in his car.

Reports said she scratched him and hit him and begged him not to rape her -- fearful he had HIV

This whole "incarceration" thing is silly.

The court should simply be able to declare Morales Rodriguez Hernandez de Punto as not possessing sufficient human qualities to support treating it as anything but an inanimate object.

In other words, surgically remove any protection he has under American law, and declare him furniture, or grass clippings. If anyone knifes him, or shoots him, or drags him behind a truck until there is nothing left but a red stripe down the road, oh well, too bad. You can't murder a toaster.

And the cost of this legal excommunication would be virtually nil.
