Double Jeopardy at Copenhagen

At the Copenhagen summit, there isn't a negotiating process to reach a climate pact. There are two.

In 1992, at the Earth Summit in Rio de Janeiro, representatives from more than 150 nations—signed an agreement giving birth to the United Nations Framework Convention on Climate Change. [It] began holding sessions called the Conference of the Parties—COPs. What's happening in Copenhagen is the 15th such session, hence the nickname COP15.

In 1997, COP3 established the Kyoto Protocol, a treaty that set binding targets for greenhouse gas emissions for 37 industrialized countries (cutting emissions 5 percent below 1990 levels by 2012). At this point, developing countries were let off the hook. President Bill Clinton signed the treaty, but he never submitted it to the Senate for ratification, realizing the treaty would not be approved. But 184 other countries went on to accept it. Thus were born two tracks: the Convention process (which included the United States) and the Kyoto process (which did not). The convention encourages industrialized nations to curb emissions; the protocol requires them to do so.

In the past 12 years, one set of international talks focused on implementing the Kyoto Protocol; these were called Meetings of Parties, or MOPs. The other set were the COPs. In 2007, COP13 in Bali set a two-year deadline to reach a long-term global pact for countering climate change. Such an accord would include all nations, including the United States, and presumably supplant Kyoto. To craft this treaty, the Convention set up a working group on "Long-term Cooperative Action" (LCA)

But—to make this more confusing—since 2005, the COPs and MOPs have been held at the same time. So COP15 includes the US-free MOP and the US-involved LCA.

This split gives nations a handy way to try to wriggle out of tougher commitments.

The joke is on them the president can sign a treat but if it is not ratified by our congress then it is not worth the paper it is written on just like all other treaties that have been written.

You would think the whole scheme (or set of schemes) would be moot at this point, since the “global warming/climate change” scam has been thoroughly exposed for all the world to see. The emperor has no clothes. They can all go home now.

“ [The President] shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present [EM] concur.... ”

All they need is a Senate quorum and 2/3's of the votes there.

definition of quorum : quorum - The number of Senators that must be present for the Senate to do business. The Constitution requires a majority of Senators (51) for a quorum. Often, fewer Senators are actually present on the floor, but the Senate presumes that a quorum is present unless the contrary is shown by a roll call vote or quorum call.

Greenhouse Gas Reductions in Copenhagen Without Waiting for Congress

COPENHAGEN— The Center for Biological Diversity’s Climate Law Institute released a report today demonstrating that President Obama has clear legal authority to commit the United States to reducing greenhouse gas pollution. The report, titled Yes, He Can: President Obama’s Power to Make an International Climate Commitment Without Waiting for Congress, concludes that the President need not wait for Congress to act before taking strong action to reduce U.S. emissions.

The report will be released in Copenhagen this evening at a side event hosted by Greenpeace.

“President Obama’s hands are not tied by Congress’s lack of action or the grossly inadequate cap-and-trade bills currently under debate. President Obama can lead, rather than follow, by using his power under the Clean Air Act and other laws to achieve deep and rapid greenhouse emissions reductions from major polluters,” said Center attorney Kevin Bundy, the report’s lead author. “Obama can use his authority to make a binding agreement in Copenhagen without additional action from Congress. The Constitution and existing domestic environmental laws give President Obama all the power he needs to join with other nations in making a real commitment to solve the climate crisis.”

The report cites prominent legal scholars and U.S. Supreme Court opinions recognizing the President’s broad power to make binding international agreements that do not need to be ratified by a two-thirds majority vote in the Senate. For example, the President could enter into either a “congressional-executive” agreement under authority already granted by Congress, or a “sole executive” agreement based on his own constitutional powers.

The report also details the President’s broad authority to reduce domestic greenhouse gas emissions under existing environmental laws, including the Clean Air Act, Clean Water Act, Endangered Species Act, and National Environmental Policy Act. The release of the report follows yesterday’s important finding by the Environmental Protection Agency that greenhouse gases endanger public health and welfare. That decision will facilitate comprehensive measures to curb greenhouse gas pollution under the Clean Air Act.

“The President has the ultimate responsibility for enforcing domestic environmental laws, and those laws give him a wide variety of options for reducing greenhouse gas pollution,” said Bundy. “All he has to do is promise the international community to use the authority he already has.”

“It simply isn’t true that President Obama cannot make a commitment in Copenhagen. Yes, he can, and if the world is to avoid the worst impacts of climate change, he must.”

Bundy is fall of crap. He’s arguing that the president has dictatorial powers. But I’d expect no less from the eco-nazis at the Center for Biological Diversity cult. The center’s bizarre interpretations of law have seen them laughed out of court and fined. The only people who MIGHT be more batsh*t crazy are their Bretheren and fellow travelers at Der Stürmer.

John Bolton is saying that President Obama cannot act independently, or at least he was last I heard him speak on the matter

I thought that the recent giant EO on management of the Chesapeake Watershed in combination with the announcement of the EPA on carbon regulations has pointed to the fact that this Administration believes it can move ahead and do anything it wants without the People's representatives being involved.

Marsh, you could be right. Not familiar with the Chesapeake decision. Your guess is as good as mine. We do know, though, that king obuma and his fascist congress refuses to follow the rule of law.

So maybe king obuma can move ahead and do anything he wants. If that’s the case, then one counterbalance to the goosesteppers is voting against his fascists from the rooftops.

Not advocating that, of course, just postulating a mitigating, or balancing, factor.

I still believe, though, that king obuma must navigate many courts and subsequent decisions before he can get his way. The courts are as jealous of their power and want to keep that power as obuma and his rabid dog followers want to sieze power.

Think Guatemala and be happy!

The Committee shall manage the development of strategies and program plans for the watershed and ecosystem of the Chesapeake Bay and oversee their implementation. The Committee shall be chaired by the Administrator of the Environmental Protection Agency (EPA), or the Administrator’s designee, and include senior representatives of the Departments of Agriculture (USDA), Commerce (DOC), Defense (DOD), Homeland Security (DHS), the Interior (DOI), Transportation (DOT), and such other agencies as determined by the Committee. Representatives serving on the Committee shall be officers of the United States.
