To sue or not to sue? That is the question.

After racist statements were made up out of thin air and then attributed to Rush Limbaugh, these were the options he had.

It is easy for me to understand that these are not simple choices because I have faced those options as well. Recently there have been a number of columns made up by others and put on the Internet with my name on them. The things said in those bogus columns have nothing in common with anything that I have said, in my columns, in my books or anywhere else.

Years ago, CBS reporter Lem Tucker said in a broadcast on Oct. 13, 1981 that my views "seem to place him in the school that believes that maybe most blacks are genetically inferior to white people."

Anyone interested in the facts could have discovered that I had argued directly against this idea in a number of writings, including a feature article in the New York Times Magazine on March 27, 1977.

An attorney I did not know, but who had read my writings and knew that what was insinuated in that broadcast was totally false, offered to represent me in a lawsuit against CBS. That was when I faced the kind of dilemma that Rush Limbaugh faces now.

When someone is considered to be a "public figure" — and Limbaugh is certainly that — the Supreme Court has narrowed the grounds on which that public figure can sue for libel, to the point where even the most blatant lie can often go unpunished.

If I was Rush I would carefully pick my target(s)and go after them. He might very well have a case. I think this why he had Checketts publicly “fire” him in case he decides to go after someone.

Limbaugh has an easy solution: sue the slanderers in England.

The English have a perverted libel law, to the point where truth is no longer a defense. All that matters is that the alleged libel was published in Britain, and that the person addressed feels that they have been libeled.

In other words, it is a travesty of justice. But it has been upheld by their courts.

In one grotesque example, a Saudi prince implicated in funding terrorism, sued an American author because a small edition of their book was published in England, though it was mostly published in America. The evidence against the Saudi prince was documented, established and true. And he still won the libel suit.

So all Limbaugh need do is to determine if the any of those who libeled him were published or broadcast in England. If so, then he needs to retain a solicitor in England to press the lawsuit, seeking substantial penalties.

Though most of those mutts have their assets in the US, a finding against them would mean that they could not travel to Europe any more, and any assets they had in Europe could have a lien placed on them.

This could be a major pain in the rear end to them if they like to visit Europe.

From what I understand, in a Libel case you have to prove that someone lied about you and prove that the lie damaged you in some way.

Rush was denied ownership in an NFL team based on the lies being told about him.

He clearly has grounds.

Sowell gives compelling reasons to consider litigation, but i am sticking with my initial position, not to sue.

And if Rush does file, I sure hope it doesnt get televised on Court TV. The left would be salivating at the prospect of putting Rush under the microscope of litigation in front of the entire nation.

It would be bread and circuses for the unwashed masses, complete with liberal commentators telling their viewers what a terrible witness he is. And speaking in a court of law is quite a different element than from behind the golden EIB mike.

He’d be off his turf and not in control of the situation.

He doesnt need the money, and he doesnt need the grief.

Common decency should be the first line of defense, so that people who smear others will pay a price in the outrage that their lies should provoke, even among decent people who do not agree with the target of their smears.

Dr. Sowell is so right and says it so well, the people slandering Rush Limbaugh have no common decency.

You're quite right, and that's a point I'd like to add to my other points in post 12 above.

Even if he beat their infantile brains out in court, they still wouldn't behave like normal people with common decency; that is a lesson they won't learn, nor a trait they would acquire, either by losing a lawsuit or otherwise.

While many public people are harmed by the lack of legal options Dr. Sowell explained, I think Rush is in a different league than most.

Not only does he have a vast history that anyone can search through for themselves, he also has 3 hours a day, five days a week to address those who have slandered or libeled him. And he has a lot of friends and in addition to those who at least respect him who all can stand up if necessary.

The man may be opinionated, but people know he's not an ugly, vindictive asshole like many public figures. If Dr. Sowell will stand with you, you must be a decent human with good character.

Sowell's right about Rush being a public figure - and that makes suing difficult. If he did sue, the MSM would use it as an excuse to trash him... and it would take the pressure off what Rush is trying to accomplish - and focus pressure on him personally. It would be a distraction. Also, Rush has a microphone - and he can use it...

For our part - boycotting the NFL is an obvious choice ... we stopped watching movies, buying CD's, reading and watching the MSM... we can drop football...

As long as liberals think this behavior is acceptable and doesn’t require an apology, there will be a huge rift in our society. Such a lack of integrity, and they see nothing wrong with it.
