Judge tosses out Army captain's complaint questioning president's birth; Orly Taitz on notice

U.S. District Court Judge Clay Land today tossed out a complaint by an Army captain fighting deployment to Iraq by questioning the legitimacy of President Barack Obama.

Land also put attorney Orly Taitz, who represents Capt. Connie Rhodes and is a leader in the national “birther” movement, on notice by stating that she could face sanctions if she ever files a similar “frivolous” lawsuit in his court.

“(Rhodes) has presented no credible evidence and has made no reliable factual allegations to support her unsubstantiated, conclusory allegations and conjecture that President Obama is ineligible to serve as president of the United States,” Land states in his order. “Instead, she uses her complaint as a platform for spouting political rhetoric, such as her claims that the president is ‘an illegal usurper, an unlawful pretender, [and] an unqualified imposter.’”

Rhodes, who filed her complaint Sept. 4 in the Columbus Division of U.S. District Court, argued that some facts point to Obama not being naturalized or possibly an illegal immigrant.

“This plaintiff cannot in good conscience obey orders originating from a chain of command from this merely de facto president,” Rhodes’ complaint states. “This plaintiff cannot be lawfully compelled to obey this de facto president’s orders.”

In his order, Land states in a footnote that Obama defeated seven opponents in a “grueling” primary campaign that cost the contenders more than $300 million. Obama then moved on to the general election, where he faced Sen. John McCain, who Land states got $84 million to wage his campaign.

“It would appear that ample opportunity existed for discovery of evidence that would support any contention that the president was not eligible for the office he sought,” Land says.

The judge adds that Congress hasn’t started impeachment proceedings against Obama, appears satisfied that he can hold the office and has rejected the suggestion he isn’t.

Everyone keeps messing up by filing this things in liberal controlled areas.

I didn't realize that Georgia was a hotbed of liberalism. And wasn't one of the birther cases tossed in a Texas court?

The American people want this socialism: they think they will get something out of it.

My hope and prayer after attending Saturday's march is that there are still enough of us freedom-loving, independent-thinking Americans to swing the pendulum of socialism the other way, but we need to keep turning the screws...

Because it has always been self-evident! Armies of friends, relatives, and townsfolk stood ready to testify.

So?...Since Obama does not have the high quality standard of having fellow citizens ready to stand forth to testify before God of his natural born status, then it is not unreasonable for him to present the lesser standard of a few modest documents.

An honest man would be **HONORED** to promptly prove to all that he was natural born and qualified to be president. That he has fought so vigorously not to do this says plenty about his character. It also tells us a lot about the character of the people defending him.

I agree. It is Obama’s responsibility to show he is eligible and the states and Congress to confirm that which all they did was sleight of hand. There are two documents signed by Pelosi and notarized showing this.

There is a little more to this than simply going along with how the courts work.

I have no idea....that’s just what he said so probably other liberals think the same thing. Interesting that he didn’t dispute that zero is trying to hide the real document.

Zero himself has supplied all the evidence necessary. His father was a British subject. I don't care how many primaries he won or how many voes he got. If he shouldn't have been on the ballot it matters not. If this judge feels that is not a barrier to the presidency let him open his court and say so on the record.

It’s partially her own fault. She just couldn’t stay away from the “usurper” type comments and keep it strictly legal.

OTOH, I was hoping this issue would finally get its day in court to end it once and for all — either way. This judge looked like he was going that way, so maybe somebody got to him, “No higher bench for you, ever, if you don’t drop this now.”

Judge Land Presided over MAJ Cook’s hearing and was also dismissed.

I would characterize anyone able to make the statement this judge did, to be incapable of Conservative thought.

His comments about monies spent by Obama’s Democrat opponents, and the $85 million McCain had at his disposal can’t be taken any other way than to depict Obama as an underdog.

This judge is a moron.

Different case. The case in CA is the one to which she is making the 30 Day reference.

The case discussed on this thread is for different Plaintiff in a different district (GA)

The trouble is that BHO’s control of the evidence (the BC) prevents the plaintiff from being able to obtain said evidence.
