You are a statist just like the Justices who wrote Roe. Defining what is and what is not murder is NOT an enumerated power and therefor not within the power of the federal government.
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
