In August 2007, Burritt placed a tractor trailer--where he stores supplies for his company, Acts II Construction, Inc.--on his private business property along U.S. Route 11. The trailer displays a gospel message to each direction of highway traffic and is one of many ways in which Burritt uses his property to evangelize. He was cited that year by Gouverneur town officials over the message, but the charges were dropped after interaction with ADF attorneys. Burritt then received a letter in May 2008 from NYDOT stating his trailer was in violation of state law and would be declared a "public nuisance." NYDOT asserted that the trailer required a permit and must be removed or face forcible removal and legal action, even though it does not require permits for similarly displayed commercial messages. ADF attorneys filed the lawsuit, Burritt v. New York State Department of Transportation, in June 2008 with the U.S. District Court for the Northern District of New York, alleging the state violated the Constitution through its discriminatory treatment of Burritt's speech. After filing, an agreement was reached with NYDOT to let the trailer remain until a ruling could be rendered. The court issued a preliminary injunction last December preventing NYDOT from removing the trailer sign while the rest of the case was being litigated, and denied the state's motion to dismiss the case. The atheists are paying to put anti-God messages on the backs of city buses and I didn't see any DOT complaining about that.

I also find this disturbing; that recognition of the most fundamental exercise of the freedoms once guaranteed by the Fisrt Amendment is now a major news story. Persecution of Christians is slowly becoming official government policy. I won’t be surprised to see Obama create an agency to do just that.

Some of us are going to have some fun then.
Over here in the UK, where the atheist/agnostic/humanist bus slogans came in a few months ago, it was made clear that they were put up in response to the Christian messages which had been on buses for a long time before that. In my view, as long as all groups have equal access to this right, then it has to be allowed on grounds of free speech.
In this case especially, there are no public law/justice issues to muddy the waters. It doesn’t matter what’s on the sign (within reasonable limits such as incitement to racial hatred), the person clearly has the right to display it on their own ground.
If we truly had "First Amendment" rights, one would not NEED a settlement with anyone.
His trailer, his property, his first amendment right...end of story.

As much as I appreciate what the ADF and other such organizations do in these cases, they utimately turn out to be a cruel joke.
All the court said was that HIS trailer could stay. The poor sap 3 miles down the road, or the guy in the next state, has to go through this whole process again.
The ADFs approach requires 150,000 lawyers, working 24/7, including 4th of July, just to keep even with the attacks.
Amen to that.
