It might. I have thought all along that the fatal flaw of the abortion mandate is that it runs counter to so many widely held and supported attributes of the law and culture. Rightly considered there are inconsistencies one after another that should eventually bring it down. But we didn't emphasize the litigation trail, for most of the time, we went for long bombs like the Human Life Amendment, overturning Roe, and other nonstarters.
Legal actions like this one have potential because they rest on a broad body of law, not just the bastard progeny of Griswold.
