If a foreigner can serve as POTUS without having to prove his citizenship status, can a foreigner vote in an election, again without having to prove his citizenship status? I’m a Canadian citizen living in the US and figure that Mrs Palin could use my vote in 2012.

The Supreme Court never comments on why it turns down a case.

Perhaps the Berg case is the stronger of the two. Furthermore it was filed by a Democrat which seems more fair and objective. Plus Berg seems more capable as a lawyer to make the case both in the press and the court.

Berg can't be that great. So far he's failed in his attempts to have George Bush and Dick Cheney indicted for their crimes relating to their part in the 9/11 conspiracy.

This is really about the secretary of state not doing her job .. putting uncertified people on the New Jersey ballot.
His case clearly showed that the sos put one well-known foreigner on the ballot and two questionable candidates in Obama and McCain.
The supremes do not want to take this on because of the political implications..... they do not want to defend the constitution.... GUTLESS ... Impeach them all !!! or at least the ones who refused to hear the case!

The court system is now in the hands of the liberals. Only those issues that libs want heard will be heard. This country can now toss the worthless Constitution and just depend on courts to make the laws.

A couple of newspapers east of the Mississippi have done so over the past week, but they did it kicking and screaming all the way. However, they have all slanted the coverage to portray it as being a negative issue, instead of the issue being of paramount importance: Does the U.S. Constitution matter anymore?

Ironically, that is exactly what the SCOTUS is doing in this case. They are refusing to make law, and relying on what the Constitution says. Donofrio’s case was an interpretation of natural born citizenship, that was not reflected in the constitution. There is no reference to dual citizenship disqualifying one for natural born citizenship. Scalia, Thomas, Alito and Roberts are not liberals. If you are willing to claim that they are, just so you can push this silly argument, then you are no better than those at DU.

You have your interpretation and I have mine. Show me in the Constitution where it says a person can hold the office of President while not being a “natural” born citizen. Matter of fact the Constitution states that one must be a natural born citizen. Obama is not a natural born citizen and for you to deny that means you must be from DU.

The justices sidestepped this issue because they were afraid of the fallout from an adverse decision. They did this for what they considered the “best interest” of this country and in the end they shattered our Constitution.

I didn’t realize you were a constitutional scholar. I must have missed the definition of natural born citizen that is mentioned in the Constitution. I don’t recall where it says that both parents must be US citizens for a child to receive natural born status. Could you kindly show me where that part of the Constitution is?

You tell me, what is the definition of a natural born citizen? It is the duty of the SCOTUS to interpret the Constitution. They failed in this duty by putting it on ignore. They don’t know so they don’t rule? Pretty sad.
