I am awaiting clarification from the Clerk's office at the United States Supreme Court as to whether my stay application has now been accepted in lieu of a more formal full petition for certiorari (and/or mandamus or prohibition). Such a transformation is a rare and significant emergency procedure. It was used in Bush v. Gore, a case I have relied on in my brief.
We do know the case has certainly been "DISTRIBUTED for Conference", a process usually reserved for full petitions of certiorari. Stays are usually dealt with in a different manner. As to a stay application, a single Justice may; a) deny the stay; b) grant the stay; c) refer the stay to the full Court.

Perfect analysis
Leo does not hang his key claim on Obama being born in kenya. Leo approached it by including that claim as a backup but also assuming he may be born in HI. He then figured out why he would be ineligible even if he was born in HI. Eh scoured the Constitution and realized if the father is a British citizen at O’s birth then O is a British citizen which is strictly verboten with the Framers. The Framers specifically guarded against this.
And what would occur if John McCain were also found not to be a natural born citizen?

I fail to see any danger in a suit that aims to force the person in charge of free, fair and legal elections to perform due diligence.
I don't believe the court is being asked to rule directly on anyone's eligibility, although even if they were, I'm convinced we could use a bit of legal clarification around that point as well.
What are the odds of the court ruling that the topic is none of our business? To me THAT would be the only danger and something of that sort is a risk with ANY case that goes before the court.

Some of these suits throughout the country are being brought by the election officials from various states, who are charged with vetting the eligibility of the candidates that they are putting on the ballots.
This is not an inchoate right that is hard to define, but a direct and fundamental right of each and every voter in the country.
I know I would recommend that the US congress provide by statute that any candidate for federal office prove that he is qualified and place that proof in the public record.
