SCOTUS upheld the FCC’s general right to enforce The Fairness Doctrine “where channels are limited”, but the courts have generally not considered that the FCC is “obliged” to do so (Red Lion Broadcasting Co. v. FCC, 395 U.S. 367 [1969]). Imho, congress would likey end-run the FCC this time, setting themselves up as the enforcers.

Forgive my ignorance (and intellectual laziness), but would a “fairness doctrine” be able to apply to Satellite Radio? Are Sirius/XM radio governed by the FCC or does the fact they are “satellite”/premium change how they are governed? (Much in the same way HBO versus ABC?) ....

Problem is that there are now thousands of stations and channels. It would make any enforcement next to impossible.
