Congress has the power under the 14th Amendment to enact legislation to ensure that no state deprives anyone of life, liberty or property without due process of law. There are legal arguments about exactly what this gives Congress the power to do and the Court in the late 1800’s restricted this definition very extensively in the Civil Rights Cases. However, I think there is still a very good faith argument that U.S. Congress does have power to do what it did under this provision of the Constitution.
I guess we know who one of the posters who will be voting for Hillary according to the FR poll is.
If there was any doubt that the media excels at propaganda, the photos of Terri is Exhibit A.
The media never bothered to ask the tough questions such as, "why can't we see Terri?" or "Why is she alert and aware?" The answers of course were "it would violate her privacy rights" or "she was already dead". Oh really.
People were misled and Terri died on 3-31-2005 about 9:00 am est.

It is absurd (IMO) to argue that this gives Congress the right to sit as a court of final appeal for any state court action, or any other judicial matter.
This would confer on Congress the power of the Directory, or the Committee of Public Safety.
It is tyranny, pure and simple, and the people will have none of it.
The fact of injustice (which is everywhere present, until Jesus comes) is not a justification for a Federal legislature of unlimited powers.

Imagine it took all those cops to make sure that one innocent person would be killed. Judges have way too much power when the judges take control of law enforcement to enforce an illegal order.

The priest had to keep a foot distance from Terri as did her parents and siblings. The police in the room would not allow her blood relatives or priest to get more than a foot close to her. Imagine police being in what may very well end up being someone’s deathbed and keeping between Terri and them. That has to be a civil rights violation as well as a sin. It’s too nazi germany for me. The whole two weeks felt like we were in cop world.

They didn’t sit as a court. All they did was give the appelate court original jurisdiction so that it could re-examine the facts that Judge Greer had already found. Otherwise, any factual determinations that Judge Greer had made would have had to be given substantial deference and could only be overturned if they were shown to be clearly erroneous.
Yep. There it is. It is so obvious to me that she is responding to the doctor’s request. If this was just random movements, she wouldn’t turn her head toward the doctor, lift her head almost off the pillow and open her eyes so wide and even raise her eyebrows.

I do not disagree with anything you say, except that I don't know enough about Florida to know if Greer committed a crime for which he could be incarcerated.
The failure of Florida's courts, and especially of Florida's governor, left Mrs. Schiavo without a remedy.
That has NOTHING to do with the farce that was played out in Congress, which should give any adherent of the remnants of Constitutional governance nightmares.
AND, by the way, it should also give Mrs. Schiavo's advocates some insight into why they are out of power, and aren't coming back anytime soon.
But that appears to be a vain hope.
The guilty parties are cursed but hold Terri's Florida supporters harmless. She was starved and dehydrated inside and outside, the cops could have shot people. They were itching too. Swat, local cops, fbi, wackenhut, german shepherds, and homeland security. If they went after the Mexican border with that kind of zeal, we'd have a secure border by now.
But in order to do that, they first had to act as a fact-finder with regard to complex matters which had already been litigated to the nines.
Congress has no competency to do this, and the power which they claimed by so doing is a power without intrinsic limit.
They were wrong, and this reckless usurpation played a significant role in the recent change of power, IMO. And until Republicans understand this, they aren't coming back.

You missed that the President came to Pinellas, met a hospice volunteer at the airport and gave her a volunteer spirit medal, then attending a million dollar gop fundraiser at Greer’s friend’s home. Greer will never be tried but he belongs in prison. The gop mafia in Pinellas has his back, even George W. Bush has his back.
