How many of you out there know of companies that have dozens of illegal workers on the payroll. What will it take to bring these companies to justice?

It is just not companies, I agree they hire lots of illegals, but many illegals work for family members, or are in business for themselves, and have a net work of workers who are illegals and they are working, without taxes paid, or any form of identification needed.. paid in cash and they are happy..skirting every law we have

Other than for show-boating or necessary photo-ops, we probably won't see much enforcement.

Now that the Comprehensive Latin American Relocation & Enrichment Act of 2007 is dead, I do hope to see some piecemal enforcement legislation brought up and passed.

Pressuring politicians to enforce the existing immigration laws and reporting any companies known to be doing business with illegal aliens.

Go into any new home subdivision under construction and check out the subcontractors. Should be easy pickens for an astute ICE investigator.

Do you want to know what will clear up this problem in short order?

Allowing private competing businesses and American legal residents seeking work in a particular industry to sue for damages those businesses who compete unfairly by hiring illegal workers.

Damages will be presumed by the mere fact that a business is operating using illegals. In other words, a business or individual would not, under my proposal, need to actually prove exactly how much they or their business were harmed by the illegals-using business. The amount of damages needs to be enough to incentivize other businesses and workers to collect evidence and go to the trouble of proving their case, and enough to punish illegals-using businesses so that managers will want to avoid that expense.

Businesses today are exposed to lawsuits if they don't hire someone because that person is a racial minority or has a disability. We need to expose businesses to similar lawsuits for hiring illegal workers.

What will it take to bring these companies to justice? Answer: Hit the companies in the pocketbooks. Lawsuits where current employees/former employees (laid off)/people who applied and weren't hired get TREBLE DAMAGES (triple damages) as stipulated in the RICO statutes of 1996 for companies that employ illegals either directly or via surrogates (i.e. temp agencies, contracting firms, consulting firms, etc). The Supreme Court already reviewed a case brought against Mohawk Industries (Georgia based carpet manufacturer) by its current/former employees who are suing for - lost work wages - raises they didn't get - pension increases they didn't get because Mohawk hired illegals via a temp agency. And these damages will be triple damages. In the opinion of the Supreme Court watchers (based on the questions asked), it appears that it is going to be a unanimous opinion in judgement against the company. Lawsuits are stacking up against companies that hired illegals, including competitors who lost business/contracts to those that hired illegals.

Asset forfeiture. I guarantee that with only a few well publicized instances of property (such as business, homes, vehicles) being seized for using illegal aliens the problem will pretty much cure itself.

Short shameful confession: I used to employ illegal aliens in the mid 90's. Not Mexicans but the ones that most people don;t think about; Irish, Canadian, Russians and others who violated the terms of their visas. I did this knowingly, with forethought and with the advice of an attorney. Why? Because there is no downside. Let me state that again with emphasis THERE IS NO DOWNSIDE.

Until that changes nothing will change.
