If it was required by state law, I would think it has happened.

I can say with absolute certainty that no Democrat Governor has ever filled a vacant Senate seat with anyone not of his own party. I can't say the same of Republicans without doing the research.

Add this to your research:

What happens if the two elected Independent Senators, Lieberman and Sanders, are added to the mix. Keep hearing 51 Democrats and 49 Republicans. Thats 100 Senators. Where are they????? I know, not on the subject, but interesting.

Dead and disabled democrats have been voting in elections for years - I don't see why they can't vote in Congress.

The TV interviews are rather boring, though.

Besides the Democrat Gov of Georgia appointing a Democrat to fill a Republican's seat, it also happened in PA.
In 1991,when the Republican Senator John Heinz of Pennsylvania ( Teresa's first husband )of was killed in a plane crash - Democrat Gov Robert Casey ( Senator elect Bob Casey's father ) appointed a Democrat ( Harris Wofford ) to fill the Republican's seat until a special election.
Wofford won the special election in 1991 and served out Heinz's term until he was defeated by Rick Santorum in 1994.

Here's a list of all appointed senators since 1913.

I don't know which of these Senators were appointed by governors from the opposite party. Will keep looking.

Because John Kerry was about to be elected President of the USA couple years ago (snicker, snicker), the Massachusetts legislature passed a law that stated the sitting governor MUST appoint a senator of the same party as the former senator.

Well, fortunately, the law was not needed. But I wonder if a republican could simply change party to become a democrat - temporarily, of course?

I'm trying to remember that Dem Senator that died in Minnesota, where the funeral turned into a Democrat celebration, but I think a third party was nominated?

So if a (R) Gov. did appoint an (R) senator that may upset the balance of power I could see the Dem's taking that to the Supreme Court.

Jim Hodges (D) threatened to appoint a Republican or a nonpartisan placeholder to replace Sen. Strom Thurmond, who was not expected to make to the end of his term by most of his colleagues. As a Democrat governor in a conservative state, he probably felt it was best not to piss off his voters and appoint someone of the opposite party from Ol' Strom. Fortunately Thurmond made it to the end of his term, and it never came up. And Hodges lost anyway in 2002 to Mark Sanford!

When Robert Kennedy was assassinated, Nelson Rockefeller appointed Republican Charles Goodell to fill Kennedy's New York senate seat. According to Wikipedia, Goodell had been relatively conservative in the House, but in the Senate he followed senior Senator Jacob Javits's liberal policies.

"Rocky" obviously didn't feel obligated to appoint a Democrat, or to do anything he didn't want to do, ever.

But that's not what you're asking. There's a list of appointed Senators since 1913 on the Senate website. If you really, really want to know you can check it against governor lists elsewhere on the net.

For a long time, many states were virtually one-party regimes: so the Senators and Governor of Alabama would all be Democrats and those from Vermont would all be Republican, and the problem just wouldn't come up.
