It seems that House and Senate rules are different. Wellstone and Torricelli were Senators. DeLay and Foley are Representatives.

Senators were appointed by State legislatures until the 17th amendment passed in 1913. The power of the Governor to appoint Senators is still left over from pre-17th amendment days, but House vacancies go to a special election.

According to an AP article on it, it stated he can be replaced. That's where I got the answer. It is the AP after all, so who knows.
