Accused Burglar Sues Homeowner Who Shot Him

MADISON, Wis. -- An accused burglar who fell through the roof of a Janesville home and was shot is now suing the homeowner who shot him.

Kurt Prochaska was arrested last October and charged with burglary, WISC-TV reported.

The homeowner, Michael Rainiero, said he shot Prochaska after he refused to leave the house.

Prochaska's lawsuit claimed Rainiero used excessive force and that he intentionally shot him in the back, trying to sever his spinal cord.

The Rock County district attorney believed Rainiero acted in self-defense and never pursued charges against him.

Aside from putting the intruder down permanently the only other way of dealing with lawsuits is to change the legal threshold.Lawsuits should have to meet the same criteria as a criminal action,NO MORE PREPONDERANCE,they too must be,BEYOND A REASONABLE DOUBT.Preponderance only means you had more liars on the witness stand!

In Massachusetts, you must prove that you had no opportunity to escape should you shoot an intruder in your own home. Learned this in required "gun safety" class.

Does Massachusetts require you to turn your back to an attacker?

The police routinely empty their 15 to 19 round magazines at the criminal but worry if a homeowner fires more than one shot ?!!?

A stranger with a criminal record broke into the home and refused to leave.
The only mistake here was not finishing them off with one to the head.
The homeowner was most certainly in danger of their life.
They couldn't know what the criminal would do next IMO.

Anyone one who breaks into my home will never be able to sue with 4 or 5 44 magnum rounds in his chest.

Probably not in his chest. I'd never use a .44 for home use. Great for trail use though.

Wisconsin? figures. georgia law now states that you cant be sued by someone breaking into your home.tighter group next time buddy.the dead cant sue.

In Mass. gun ownership isn't a right, it is a "privilege" for which one must grovel before the local constabulary. I kid you not, kill and intruder in your home, and you have a whole new set of problems.

I've only got 4 rounds in my primary home defense weapon.

Of course those are #4 buckshot so that's something like 128 pellets heading straight for the center mass of Mr. Bad Guy.

Then after that I'll have to get the family to a secure location, find the damned phone, find my damned glasses, get the dogs outside so they don't lick the cops to death, put on a pot of coffee for the cops, oh yea...where is the damned phone...

Sorry Mr. Bad Guy, I'll get the ambulance rolling in just a tick....
