No one is denying that it came from custom, practices, etc. However, that had to be created into legal principles, which traditions to follow and which traditions to throw aside, that was done by judges. Black's Law Dictionary defines the common law as "the body of law derived from judicial decision, rather than from statutes or constitutions." (2nd pocket ed.) It is judge made law.
