I think it would be a very interesting promotion for growers to certify that produce was harvested with legal labor. I would pay more for it.

So would I! Buying from your local farm market you'll probably get fresher produce, lower prices and no illegals deficating in the fields.

I don't expect to see any growers promoting illegal-free produce any time soon. The lawsuits from the ACLU would put them out of business.

The ACLU wouldn't sue, but the big growers who love the Mexican slave labor certainly would. It's like the dairyman who advertised that his milk was not irradiated. The dairy association sued because they said it implyed that their irradiated milk wasn't safe, and I think they won the case, since they had more money, of course.
No, growers would need to market illegal-free produce as "family grown and harvested" or some-such PC term. I, too, would pay a dollar more per head of lettuce if I knew that someone who knew to wash their hands after using the toilet had picked it.
