Wal-Mart In Court Fight Over 'Wal-ocaust' T-Shirts

ATLANTA -- A Georgia man has filed a lawsuit against Wal-Mart in federal district court in Atlanta in a fight over his T-shirts that compare the retailer's business practices to the Holocaust.

Charles Smith has been marketing shirts that read, "I (heart) Wal-ocaust" T-shirts. Wal-Mart filed a cease-and-desist order in an attempt to make him stop printing the shirts.

The company said Smith is engaging in trademark infringement. It has threatened to sue Smith if he continues to display the logos on his Web site and to print them on his products.

The 48-year-old Smith is a computer repairman and said he has no deep connection to the company. But he claims using the logos is a free speech issue.

Smith said he came up with his anti-Wal-Mart logo after conversations with a customer and an employee who both had bad experiences with the retailer.

He designed his first logo in July. One shirt -- with "Wal-ocaust" printed above an eagle and a smiley face sold on Nov. 16 and netted Smith $5.10.

He said if the court sides with him, he will use any profits to pay his legal fees and for continued production of the products.

Wal-Mart spokeswoman Sarah Clark said Smith is infringing on the company's trademark and also "making an offensive association between Wal-Mart and one of the greatest tragedies of the past century."

I don't see WM making him any kind of offer. He's suing WM because they filed a cease and desist order. I don't even understand why he's suing.

I love Sam's Club! Butter for a buck a pound less than Shaw's or Hannafords, choice cuts of meat thick cut the way beef and pork should be, 100% Arabica coffee beans for $4.50 a ton, at least 35/40 different kinds of chicken, specialty foods and holiday chit you can't find outside of a catalog.

People giving away food! With proper planning you can start of with an appetizer, move on to an entree (hangdog beagle look gets you seconds), and top it off with desert and a cold refreshing drink!

I go there four times a week just for lunch.

That "idiot" at the door is your friend and if you smile and nod, some day he might help you load the 42" HDTV you've been hawking out into the back of your PU.

Whether you've paid for it or not...

Perhaps...some of the Islamic theocracies or Arab dictatorships.... But they also wouldn't have produced the inevitable, immediate backlash

What Pre-emptive strike? WM already filed a cease and desist order - he needs to be fighting that. WM is not the ones at fault here.

Walmart is just trying to put american companies out of business with Chinese products. This is the Bush/Clinton/Bush America.

You know, just to urk these looney libs a little more, Wal-Mart should have a skeet shoot in the parking lot. Most of them have enough area that if they marked off half of it, they would be within the guideline of most shooting ranges.

YOu act as if WalMart has not competition.......which of course is not the case. There is no antitrust involved here.

And as for WM being no friend to conservatives, you out to check out the link you posted to back up that claim. Linking to leftit crybaby whining is not a way to prove (an unproveable) a claim.

Actually, I don't think too many American Muslims are all that attached to the repressive regimes in the Middle East and South Asia. They may get upset when the people of those countries are harmed, but they don't care much for the corrupt leadership. In fact, our support for those leaders seems to make some of them angry.
