I really hope this is because they believe in what the CEO said, and that this isn't being said/done to avoid becoming involved with developers that maybe sued in the future - i.e. lawsuit over eminent domain ties up development projects for months/years, causing potential financial problems.

It really sounds like they mean it though.

If Kilo gets overturned, it won't be overturned retroactively. The Court understands how much chaos that would cause, and I assume that this bank's lawyers understand it too.

Based on that, I'd say their motivations are pure.
