The good thing about the Dems filibustering, it will give the GOP some balls to filibuster a Democrats Supreme Court nominee. The Democrats are once again raising the bar in partisan politics. Which may be good, because maybe we can shut down government for good.
I realize the filibuster is currently defined as refusing a cloture vote, but can't any Senator filibuster any Senate activity simply by taking to the floor and refusing to stop speaking?

Ohhh, I can hear the ravaged cries of the DUmmies now. They are banking on a secret fillibuster at the 11th hour.
Don't be fooled. The dems know that if they fillibuster, they will lose that tool for lower court nominations. Moreover, fillibustering such a high profile nominee would be the wrong move. Still, The kook ba$e demands a fillibuster. Thus, there would be absolute HELL for the dems to pay if there were enough votes to maintain the buster, but it was not done.
So, certain dems (preferably one's that the kook base will vote for no matter what) are standing up and saying no to fillibustering. Cover is provided, the kooks are less angry (marginally) and the lower court nominees remain screwed.
Kerry is planning a "faux-libuster" to satisfy his moonbat base. They will totally fall for it.

The Dems are not going to filibuster officially, but they are not going to vote until forced. They are starting a "soft filibuster" which is a stall.
