I don't see how this is a win for Kennedy if it was already published in the NYT a month before Kennedy made his request. Did I miss something?

Not a thing. He is stalling--trying to put off the inevitable confirmation.
I was replying to a post that Cboldt posted...that said that even thought Kennedy was told BEFORE they returned from lunch break..that there is nothing in the papers that he is trying to subpoena, to use against Alito...
he is STILL wanting to have them, and making a big who-ha about it.
IOW...even in this instance, he couldn't take the high road, and say "never mind" to what he requested before lunch.
