Fatal Robbery Attempt

Two shot; one killed

Omaha police are investigating an apparent botched robbery at Benson Jewelry and Loan that resulted in the death of an 18-year-old man and critical injuries for a 17-year-old man.

The shootings happened at 61st and Maple shortly before 3:30 p.m.

Kendall Tealer, 18, of Omaha was pronounced dead at the scene while Brandon Bowie, 17, also of Omaha was transported by rescue squad in very critical condition to University of Nebraska Medical Center.

Business owners in the area that Channel 6 News spoke with say they did not recognize either of the two people who were shot but they say that they did recognize people from the store who left with police.

Investigators said Tuesday evening that they were not looking for suspects in the shootings.

Witnesses at the scene believe employees shot the men in self-defense during a botched robbery attempt.

"At this point in the investigation, there are no suspects we're looking for," said Omaha police officer Andrew Passo.

Passo said the investigation is ongoing and anyone with information regarding the shooting is urged to contact the homicide unit at 444-5656.

It's a truly bass-ackward situation, which a concealed carry law would clear up. But that will take time, Grasshopper.

Hopefully, it happens this next session - even though the current legislation will be one of the most restrictive laws in the nation.

Announced this morning that Douglas County Prosecutor, Stu Dornan, will NOT file charges against the store owner.

Now, if only the second roach dies, this will be a perfect fairy-tale ending.

Yeah only if Ken and Norm didn't have to take cover again and both move out of their homes due to treats to them.

Actually one can only carry open in Omaha if one has a permit from the city.

Actually one can only carry open in Omaha if one has a permit from the city.

The permits are "shall issue." And that applies to the City of Omaha, not the entire state. I don't believe.

Businessman Fired Shots
Alleged robber was free on bond

Omaha Police say that one of the owners of the Benson Jewelry and Loan fired a weapon that killed a would-be robber and critically injured his alleged accomplice on Tuesday afternoon.

Investigators say that 18-year-old Kendall Tealer and 17-year-old Brandon Bowie went into the business near 61st and Maple around 3:30 Tuesday afternoon with the intention of robbing the business.

The co-owners of the business are Ken Blankenship and Norm Sargent.

Blankenship and Sargent say Bowie had a gun to Sargent's head. Blankenship fired a gun that he had behind the counter for security, critically injuring Bowie. Then, Blankenship says he saw Tealer make a quick move. He says he thought Tealer was armed so he fired, fatally wounding Tealer.

Police say that one of the suspects jumped over the counter, the other went around the counter through the swinging half door and grabbed a shotgun.

Once behind the counter, police say the suspects ordered the co-owners to the ground at gunpoint.

A statement from police indicates that one of the owners then "began to fire a gun that he had hidden behind the counter at the suspects. Brandon Bowie, fell inside of the business and is currently hospitalized, Kendall Tealer was able to get outside of the business before collapsing and dying."

Records indicate Tealer was free on bond awaiting trial on burglary and theft charges in Lancaster County when he was shot to death.

The Lancaster County case involves a crime that was committed in October.

Tealer had a long list of encounters with the law. Records show that he is linked to nine misdemeanor cases in Douglas County since 2003.

James Martin Davis, the store owners' attorney, says he doesn't expect charges to be filed in the case. He says it was a righteous shooting.

That's also the opinion of a fellow Benson Businessman.

Bryan Hill was among the concerned watching events unfold yesterday. He owns an entertainment business down the block from Benson Jewelry & Loan.

He knows both Sargent and Blankenship and says businesses have a right to defend themselves.

"Being a businessman, you hate to see anything like this happen to anybody and you have a right to protect your property," said Hill. "I think what he did was probably justified. It's unfortunate that it happened, but it did."

Blankenship and Sargent have been in business in Benson for 14 years. They say they're attached to Benson and their customers but they may not reopen after this experience.

You are right about it being an Omaha city thing. I had a OPD cop tell me the only people who can carry openly in the city are people who have a 'need', ie security people, PI's, etc.

Actually, the "need" is pretty easy to prove. But it still grates on me that of all the protections in the Bill of Rights, the only one I have to establish a "need" for is the most important of all: my "need" to self defense.

If I have to prove a need, then the question necessarily arises: "to whom?" Whomever has the power to recognize (or refuse to recognize) my need, becomes the one granting me the right. And that is precisely what the Constitution does NOT do.
