Judge: Sex Criminals Illegally Detained

NEW YORK (AP) -- A judge on Tuesday ordered the release of 12 sex criminals she said were illegally detained when they were sent to a psychiatric hospital on Gov. George Pataki's orders after their prison sentences ended.

State Supreme Court Justice Jacqueline Silbermann directed the release of the 12 - whose crimes include the rape and sodomy of boys and girls - pending examinations of each prisoner by two court-appointed psychiatrists.

She said the men had to be examined within five days of her appointing the physicians. She said unless the psychiatrists find the ex-convicts to be mentally ill or to be dangers to themselves or to society they will have to be released immediately.

Pataki issued a statement saying he was "deeply troubled" by the judge's decision and would order an appeal. He said the ex-convicts "represent a real danger to our children and our communities."

The sex criminals had been ordered held by Pataki, who, after years of failing to secure a bill that would allow civil confinement of sex offenders when their sentences end, said he would "push the envelope" legally and hold them anyway.

Pataki used the state's involuntary commitment law, which normally deals with the noncriminal mentally ill, to win extended confinement of the sex criminals.

The judge noted in her nine-page decision that Pataki "ordered state correction and mental authorities to begin evaluating every sexually violent predator in state prisons before their release to determine if they should be civilly confined."

can't we just take them out into a feild, shoot them, and then leave them for the carrion eaters? effin baby-rapers.

They should have been given psychiatric evaluations upon being convicted and incarcerated...NOT upon release.

Who are the 12?
What are their particular crimes?
Why will the press not name their names or their crimes?

The names for them are not printable in mainstream media. Going to check this judge's political background. Hunch tells me that she's a lib (babykiller, but bleeding heart when it comes to criminals)

Of course they are dangers to society.

Well if the judge is cool with it, I say we let the criminals settle in the neighborhood of the judge's children or grandchildren. I mean after all, if they are no threat to society...

Hey, I'm all for that, but confinement to mental institutions is what the Soviets did to silence their troublemakers.

If they can do it to sex offender scumbags, they can do it to YOU.

I believe this is what Pataki is trying to accomplish. After trying unsuccessfully to get this passed by a liberal state government, he took this bold, if illegal, step.

Perhaps bringing the light of day on this problem will get the citizens of NY to demand harsher sentences on these animals.

There are only two sentences harsh enough for baby-rapers. Natural life (life without parole) or a bullet in the head. I will save the taxpayers some money and supply the bullet.

(No. Raping and sodomizing children is not a danger to society)

----It kills me that they spend a little time in jail and then have to go see a doctor for an evaluation (which takes time) and it is deemed unfair. They have caused a lifetime of trauma to their victims. And as far as Jacqueline Silbermann goes, was one of her kids a victim? I doubt it, yet she calls the shots as to whether there freaks are put back on the street and how fast.

It probably would have been better to say they were handing out Bibles, at least some people would have been more wary of their release...
