Seeing as the paleocons are a minority and questionable part of his base, your argument is flatulent on its face. The 'I hate Bush' reasons for opposing the nomination are ALL based on crystal balling, by those who do not know her, that her vote will not be what Bush says it will be.

It is amusing that the opponents avoid talking about Bush's record on judicial nominations. Why ? Because they know it blows the doors off their argument. Instead they invoke CFA and Prescription Drugs which are irrelevant, he campaigned on those issues, so they were no surprise, even though wrong. He has kept his word on his judicial nominations and deserves far better than he is getting from fair weather ideologues, who would rather destroy the conservative movement if they cannot get their way. Only a fringe right wing lunatic would claim Bush has moved the court to the left. Stupid is as stupid does, and these right wing ideologues are stuck on stupid.

I agree with you. It matters HOW Roe is overturned or eroded, not if. That's why it is critical that we get a constructionist-focused justice, not an outcomes-focused justice. If she is confirmed, Miers will be on the court for twenty years or more. She doesn't appear to be a constructionist. Do we know the issues which will be before the court in 2025? No. That's what is so scary about her. If she were a constructionist, we could have trust in her. I have no confidence whatsoever that she will rule "conservatively" in 2025.

Kind of an odd name to call someone who's voting career has consisted of votes for Bush 41, Bush 41, Dole, Bush 43, Bush 43 (which is a more consistently conservative voting record than Harriet Miers' btw).

But I guess if you don't unquestioningly take everything you're given by this Administration than that's the thanks you get.

consider that if Bush were to get a 3rd pick - the current "formula" he is locked into with Spector and the McCain gang - means that we would get Alberto Gonzales.

This is nonsense. I am certain both Roberts and Miers will vote to overturn Roe.

That's fine as long as the decision doesn't erode privacy rights. If it does we will all come to regret those Governmental powers.

Many pro-life people have come to believe that if Roe was reversed, abortions would virtually disappear immediately. In actuality, nothing will change much.

But, I do believe if it were to be reversed, Republicans would be severally hurt politically.

Really? Bill Kristol and George Will are Paleo-Cons now? That's probably news to them. Now who is blowing flatulence?

(Ignoring the "I hate Bush" comment) And how is this different from those who support Ms. Miers? There is just as much crystal-balling going on on the pro-Miers side as well. The point is that there didn't have to be any crystal-balling. We could be presenting a united front and fighting the Democrats right now. Instead we are fighting each other.

No, overturning Roe v. Wade would be quite welcome. I can think of 20 or 30 other precedents that should be overturned because they are bad law, such as the Kelo and Raich decisions from this last term. I see nothing in Miers' record that convinces me that she thinks as I do.

If Miers is confirmed and is proven to be another O'Connor (or worse), The Republicans have lost my vote in the next election. I'll vote Libertarian or Constitution Party. I will pull down the Pillars of the Temple over this issue.

Roberts is the reliable conservative that Rehnquist was.

I had doubts about Roberts until his paper trail came out. Then, during his confirmation, I thought the guy was going to be the second smartest guy on the Court after Scalia. He was a member of the Federalist Society (which Miers refused to join) and wrote position papers in the Reagan Administration.

Miers has done neither. Her prior records reveal her to be a liberal and she has no proven conservative judicial philosophy.
