KANSAS CITY, Mo. -- Hardee's has agreed to pay $34,000 to settle a lawsuit alleging that one of its restaurants repeatedly refused to hire an applicant because her face was disfigured.
The U.S. Equal Employment Opportunity Commission and the St. Louis-based fast-food chain, which is owned by CKE Restaurants Inc., submitted the proposed agreement Monday to U.S. District Court in Kansas City. Besides the money, the settlement also calls for the chain to apologize in writing and further train its managers and human resources employees.
The EEOC said the suit, also filed Monday, alleged that the job seeker applied more than once for entry-level work at the Hardee's in Oak Grove, near Independence, but was never hired. The suit said others with no better qualifications were given jobs while the applicant was not. The woman has Treacher Collins Syndrome, a birth defect that caused a malformed cranial bone structure, asymmetrical eye placement and the absence of ears.
CKE, based in Carpinteria, Calif., did not return calls for comment.
Not to mention the multiple piercings and meth teeth.
The EEOC should be disbanded.

I personally have a harder time buying food from someone with intentional disfigurement, such as lip, nose, eyebrow, cheek, and other piercings, than I do from someone with a deformity over which they had no control.

This is a difficult one. We had some big discussion about this disease many months ago here on FR. It is an extraordinarily disfiguring disease. I don't know. I admire this woman for her tenacity. But I do understand the restaurant problem. It's sad. I hope this woman gets a job where she can work in with peace and respect.
Mine too. But damn... I am sure there are a lot of jobs she could do, but I certainly would lose my appetite if she was my server. That may be discriminatory, but it is also plain truth.
Add a bunch of tattoos to the mix, and a big BURP from the Taco Bell server I'd seen a few years ago, and the ol' appettite vanishes into thin air.
Actually no. And as much as I hate the EEOC and all these lawsuits, the facts seem undisputed. Other applicants with the same qualifications were hired while she was not. The chain seems to agree, they are settling. And the amount is small, it seems to have been the principle instead of the money in this case.
How did they know that without resorting to paranormal means?

It's sad. I hope this woman gets a job where she can work in with peace and respect.
No employer should be forced to hire anyone. I feel for the lady but there are other jobs out there. Perhaps she can take the money and get an education and not have to work in a fast food joint.
