Karl Rove, who didn't leak anything but was a "source" of a sort, gave permission to the other reporter to release his name.
I don't think there's much doubt why the lawyers refuse to answer the question of whether Miller has asked her source for permission to talk. She can't, because she's not protecting anyone but herself, her crooked employers, Wilson, and Plame, who engineered this whole rotten business.

Over the years the generally accepted journalist standard has been that a journalist has an obligation to go to jail before identifying his source, but not to stay in jail. After a few days in jail it is acceptable for the journalist to reveal his source.
Judith Miller is no longer protecting a source, she is probably protecting herself. She probably made some lucky connections of dots and is in fact the origin of the story herself. She can't give the name of her informant because there probably isn't one.

Judith Miller is protecting Wilson and Plame, others of that ilk. There is no way, at all, that her source is Karl Rove; he long ago gave blanket permission ( twice to Cooper ! )to tell whatever he said to them.
Miller has said that she will not talk, because she "feels" that the permission to state her source, was given under duress. It is impossible to believe that Karl Rove gave his permission "under duress"! Ergo, Judith is 1) lying 2) has another source/s 3) it is NOT Karl Rove.

I thought the investigation was still ongoing. Maybe no one in the Bush administration leaked it. Since most people in DC already knew it because of her loud mouth husband.
