You're probably right, but at least it puts the matter into the "Commander's discretion" category. Or even the "First Shirt's". If nothing else, if you do something stupid, your senior NCO is going to tell you about it, and none to gently most likely.

Yeah, we're in agreement there. But I have seen more than one occasion where a Marine escaped civilian prosecution, only to have to answer via UCMJ.
