"Roe v. Wade is the settled law of the land."

That contradicts his other comments about Roe v. Wade as being "wrong"

Ruling on the appellate court is a completely different issue than ruling on the Supreme court. The appeals court follows precident, the Supreme Court sets precident.

It is being said that he will uphold RoeVWade and President Bush is well aware of that, and it is being said President Bush did not make RoeVWade his priority when choosing Roberts.
On the plus side Roberts was instrumental in getting the President elected during the infamous vote count.

There is going to be so much pressure on him for this, this is going to put roe vs wade in the spotlight and the pro choice pro life camps are going to both go nuts over this.

If the Dems can play both sides, why can't we?

No, not at all. It is unfortunately the "settled law of the land," and while he may not agree with it, it currently stands and he has no choice but to comply with it. For now.

Shame on Drudge for jumping up and down on that overruling quote. He's getting the pro-choicers more riled up than they need to be.

The first statement was made in confirmation hearings before the Senate to be an appeals judge. For that position you are expected to be bound by decisions of the Supreme Court. If you say you dont agree what the Supreme Court has decided is settled law, that is an almost automatic disqualifier for confirmation regardless of ideology.

The second statement was not his personal statement. Its what he wrote as Assistant Solicitor General of The US for his client the first President Bush and the Government of the US before the SCOTUS. He was representing his client, President Bush.

So net-net, we really dont know what his views are on Roe v. Wade.

He said Roe was settled law when he was being considered for a lower court judgeship. A lower court does not have the power to overturn Roe. It's different story for a SCOTUS justice...and he doesn't like Roe.
