From the media brief requesting an en banc hearing at the Federal Circuit Court (DC), "According to Congress's Iraq investigation, CIA officials said that while the CIA promised to keep Wilson's relationship with the CIA confidential, Wilson was not asked to sign a confidentiality or non-disclosure agreement.

The below links relate to a brief filed on behalf of 36 news organizations. One of the authors of the brief is Victoria Toensing, who has posed the same points in editorial columns expressing the function of the statute that forbids disclosure of covert operatives.

The brief itself is a 1.5 Mb PDF file - fair warning.

I don't think anyone in the (liberal) media has even asked that question since it doesn't fit their story line. The media generally only question the legality of a leak or a disclosure of classified material if the leak benefits a Republican or hurts a Democrat. Leaks which benefit Democrats or harm Republicans are rarely questioned. If Clinton was in Bush's position and Wilson was questioning Clinton's policies, the press would side with Clinton and question Wilson's motives, his connections, and his veracity. How do I know? Because that's how the press treated Linda Tripp, Paula Jones, Kathleen Willey, and Kenneth Starr.
