The Constitution says in Article I, Section 8, "The Congress shall have the power.... To provide for the calling forth the Militia to execute the laws of the Union, suppress Insurrections and Repel Invasions;..." Since we are being invaded and the laws of the Union are being violated should the Militia be called up and placed on the borders to protect the laws and the American people?

What exactly is "the militia" these days? Back when the Constitution was written, it was pretty much every man capable of military service. I don't think anyone has in mind the entire able-bodied male population going to the borders. Or do they?

I was in the Army; I'm now in the Militia, and stand ready to hear the call to arms.
First off, please bear with me. This is not easy to explain in just a few sentences.
Illegals are treated as a *special* class of person precisely because they ARE illegal...they have no *legal entity* and are still considered 'natural persons' according to law.

Any person with a valid Social Security number (like you and me) DOES have a *legal entity*.
But what is a ‘legal entity’ that makes being one so objectionable, anyway?

The term legal entity implies that a public limited liability company or foundation can be (fully independent of the management) the bearer of rights and liabilities, the management merely represents the legal entity.
So a legal entity artificial in nature, fully independent of management, but management has NO control over the legal entity.
WE are ‘management’; and this attached public limited liability company (or legal entity) is controllable by the government, warrant able by the ‘legal system’ and prosecutable in the courts under statutory (positive) law.

Actually, I would like to hear a call for volunteers. If all were asked, I'd bet more than enough would actually go.

I have frequently read that posse comitatus only applies to the army and that other branches of the service are exempt. I may be wrong about that.
It would hardly make sense to criminalize the deployment of National Guard troops on American soil because their very mission is to Guard the Nation. They were created as the home guard.

Staunching the flow of illegals is, or should be, a no-brainer.
But I believe we need to immediately have a national debate over our historically VERY high levels of LEGAL immigration. Are we letting too many in? Are they being assimilated successfully into American society?
The other important question that needs to be asked, in my opinion is this: Are those we admitting the possessors of a compatible worldview with American republicanism?
One of those groups that I strongly view as incompatible are those who believe in and practice the dangerous political ideology that is also known as Islam...

True, the President is the CIC of the Army, but you really need more:

The original intent was that the jurisdiction of the United States extended ONLY to Washington D.C. and military bases.
The ONLY long term military power given to the United States government was to maintain a NAVY (Article I Section *, Paragraph 13)

Sec. 9. MILITIA ORGANIZATION. The legislature shall pass laws necessary for the organization, discipline and service of the militia of the state.
The States modern National Guard originated with the Dick Law of 1903, which brought about greater Federalization and Standardization of all State Military Forces. Colorful 1903 Units received almost all their supplies, arms and uniforms from the Federal Government.
I have been aware of and observed the federalization of America with disgust for thirty years. This crap about sending our taxes to Washington so they can yank 40% out and then decide which Senator has bowed the deepest and who has remained on bended knee the longest to deserve the most pork is sickening.
State borders are 60 feet inside the international borders. Any Governor who has the intestinal ummph can place their State Guard on that line and Washington can't say a thing but they can threaten to only return 2% of the States taxes. The sheriffs of the adjoining counties have the authority to block all federal employees from entering their county without permission.
The authority is there, the guts to use it isn't. If any State legislature decided they have had enough of the illegals, one Bill and they become unwelcome.
I have read a couple of drafts which could clean a State up in 72 hours. Protected highway corridors and all that is necessary to permit them to leave before being arrested was one idea that I thought took some forethought. Remember when the Japanese were arrested in San Francisco? This would be the opposite, now's your chance to get out of the State, take it!

This morning, based on the apprehension last night of a large number of Syrian and Iranian nationals, disguised as Mexican nationals and carrying 60 pounds of low-grade yet dangerous radioactive material across the border near Las Putas Borrachas, I have directed the Secretaries of Defense and Homeland Security to carry out certain steps to prevent such a transfer from succeeding.
The Secretary of Defense has been directed to reduce US Army in Germany by 50% immediately, and to transfer those personnel immediately to border security operations. Their equipment will be supplied by existing stores at the various Army Depots around the country. Forces remaining in Germany will see to the redeployment of equipment thus rendered excess.
Additionally, Air Force reconnaissance missions will be redirected into the border areas to assist military and civilian border personnel in stopping and/or apprehending illegal border crossers.
Other actions will be taking place as well, and some of them will remain classified for the time being.
The Secretary of Homeland Security has been directed to coordinate the activities of military personnel on border duty, the INS, local law enforcement, and members of the Minutemen group without whose vigilance the group apprehended last night would have succeeded in their effort.
Additionally, the call is made for members of the Unorganized Militia, that is able-bodied citizens of military age, preferably with military experience, voluntarily to assist in this effort. This will be unpaid volunteer work; qualified militia personnel will be required to serve a renewable term of two weeks, and will receive food, lodging, medical care, and the equipment needed to perform assigned duties during their service.

Be a citizen of the United States, between 18 and 59 years of age;
Pass a physical;

Uniforms of a sort will be issued and worn. Equipment will be issued as needed. Veterans may be issued weapons, and strict rules of engagement will be followed.
