There is one other option left, but its a real long shot. Bush can reject the arrangement and claim it as evidence that he has exhausted all reasonable avenues of redress. Then the White house can file a Federal suit claiming that the Senate is not performing its constitutional duty. The Supreme Court would have to take it up, but where they will come down on this is any body's guess. The only thing I can say is that the President will never again have as much influence over the court as he has now.
