Jeb Bush Did All He Could Legally Do

I didn't want Jeb to exceed the law, but I am extremely disappointed he didn't enforce all of the law. FL law governing the treatment and protection of the disabled allowed him to order DCF to take control of her and her care. The executive branch is not subservient to the judicial branch. As head of the executive branch, Jeb was not required to submit to Judge Greer's order stopping the enforcement of the DCF law. Judge's cannot order the executive branch to follow some laws and disregard others. If anyone thought Jeb had overstepped the law detailing the responsibilities of DCF and the care of the disabled, they could have appealed in the courts, the same way her parents and her husband already had. If new and more detailed testing proved the diagnosis of PVS was accurate, she could still be allowed to die. Now, because that wasn't done, we may never know if we allowed the death of a cognizant disabled woman. BTW, if you will note my tag line you may know why I vigorously oppose both of the Bush brothers in their stand on closed adoptions.

When the civil rights movement was a foot there was no problems violating the courts..

When Janet Reno wanted to send little Ellian back to Castro
the state couldn't move fast enough or hard enough to accomplish that goal...

Keep chanting the mantra...'our leaders couldn't do anything'..guarantee ya that they wont have any problems extracting taxes or signing tax payers names to budget loans or voting themselves pay raises, fat perks, or even fatter retirements...

Ah yes but both FP#78 and FP#81 presume as I said "an executive with the will to perform."; Jeb Bush fails and Terri pays with her life for his failure and we all pay in terms of losing this one battle for our republic. It is good I suppose to provide the FP references but there is much to be learned by reading them in their entirety which is what I had hoped to entice our friend to do. When one says he has heard no words to support etc in this case it is either because he has not been watching the traffic or has purposefully ignored the truth to support his own agenda. I suspect the latter in this particular thread.

He is not bound by a failed ruling of the Judiciary. He is bound by the Constitutions of the State of Florida and of the US. That is where he failed. Why haven't your read those documents so your could understand his responsibilities to act?

If Bush lacks cajones for not doing anything, what does that make you? Are you not then a coward for failing to act on your pricinples? Or is it only cowardly if a governor fails to act?

I have seen some pretty stupid stuff posted on the Terri threads but this one pretty much takes the cake..

Somebody got the US Congress to back down about those subpoenas

The subpeonas were bogus from the word go. Every memeber of congress that voted them up knew in advance that they were bluffing and there was no enforcing them. That was a given from the onset. The miscalculaton was that they really didn't expect their bluff to be called.

Careful, you're on the verge of exposing one of many double standards that are at work here. This one being that the rules only apply to "them". There are those here who think the rules are ok to break as long as it's "us" breaking them.

they really missed their chance to shine. I in fact was asking to be educated by someone who appeared to have an answer or know what they were talking about. So far I have been unable to find anything to support the comments by others saying either Bush should have "saved Terri", and I don't know what they are referring to. Apparently I am not alone; they don't know either.

Oh what the heck. It's a waste of time to try to produce facts to the claims of others when they don't even know what supports thier ideas.

I haven't ever said it was Jeb's fault. The simple fact is, however, he is the chief executive in Florida and had the power to intervene and save Terri. He did not. In fact he did almost nothing. You can read the constitution as well as any of us and if you have followed this saga at all you know the avenues he could have taken to forcefully intervene using the constitutional powers accorded him. The blame for action lies clearly at Judge Greer's feet but the blame for inaction cannot be assigned to anyone but Jeb Bush. Waving your arms saying there is no proof he could do anything is a cop-out for your lack of honest review of the constitution of Florida in particular and of the US inclusive. You insist others provide proof of what he could have done while it is all the while in front of you. Why not confront the obvious and explain how he cound avoid his responsibilites under his constitution to enforce it's provisions to pretect Terri? Further discussion with those who defend the indefensible is a waste of energy. Have a nice day.

Those who blame this fiasco on Jeb Bush are just witless drooling idiots, mindless tools of the demorat party. Enabling and clearing the way for President Hillary Clinton and the loss of control of the Congress.

Jeb did all that he could short of wiping his a** with the Constitution, picking up a gun and killing a bunch of sheriffs at the hospice!

If certain mentally unstable whack-jobs object to what Jeb didn't do, it only makes him look better to sane Americans everywhere!

People have lost sight of reality when the try to place blame for Teri's death on anyone but M. Schiavo...all the others were mere accessories. I prayed hard for her survival and rescue, and am still grieving over her death and our society's disregard for life. Having said that, I also agree that Jeb's hands were tied. Many here have argued, "He should have used force...there's a life at stake!!"

Many on the left would use the exact same words to justify the confiscation of firearms.

What part of our Constitution granted Congress the authority to expand the courts jurisdiction?

Article I, Section 8, "To constitute Tribunals inferior to the supereme Court;"

See Title 28 of the United States Code for laws made pursuant to that Constitutional Authority.
