JURY PROBES EX-BILL AIDE'S 'SOCKS DOCS'-FOX News has confirmed the grand jury investigation

WASHINGTON — The criminal probe into why former Bill Clinton aide Sandy Berger illegally sneaked top-secret documents out of the National Archives — possibly in his socks — has heated up and is now before a federal grand jury, The Post has learned.

The "Socks Docs" probe forced Berger, who was President Clinton's national security adviser, to step down as Democrat John Kerry's top foreign-policy adviser last summer.

"It may have been off the front pages, but the investigation has been active," said a source with knowledge of the probe.

"[Berger] has been interviewed several times by federal agents — FBI and prosecutors."

Berger admits removing 40 to 50 top-secret documents from the archives, but claims it was an "honest mistake" made while he vetted documents for the 9/11 commission's probe into the Twin Towers attacks.

Berger has also acknowledged that he destroyed some documents — he says by accident.

The probe was touched off last spring when stunned archives staffers reported seeing Berger sneak classified documents out of a top-secret reading room in his pants and socks while vetting Clinton-era items for the commission.

They then ran a sting operation in which they coded some documents and confirmed they were missing when Berger left.

The documents were classified Code Word, the highest security classification, above Top Secret.

The commission report makes clear that Berger had a habit of writing candid notes in the margin of memos, sometimes flatly rejecting plans for action.

He nixed a plan to capture Osama bin Laden with one word: "No."

The question is: Does Sandy Berger have the same stomach for 'omerta' that people like Hubbell and other Clintonites had? This guy isn't getting any younger. If he's ever going to give anything up, he needs to start hard jail time ASAP. Marion would help encourage the scumbag to talk.

The Clinton interregnum, was the most vile and evil America has ever seen. Berger himself was obviously not driven by the desire to protect American citizens......which this Dim idiot should have known was part of his job description.

What did Berger think being Ntl Security advisor meant? He sure was not protecting our security.

Unfortunately, we will not uncover all the crimes and evil committed by Berger and the rest of the Clinton scumbags, but we need to make sure Berger gets nailed for the document heist.

Perhaps mr. burglar was just trying to "pad his resume", as it were, by stuffing classified documents in his trousers. It did seem that the clintoon administration had a preoccupation with that article of clothing. Like how do you keep these dang things from falling down all the time? Bubba's pardon powers are past, but we all know what happened to Jim McDougall and Ron Brown and the rest. Berger will not roll over, but take it like a man (bad pun intended). Life behind bars is better than no life at all.

Removal of classified documents is a crime. One would be accidental, but fifty...big problem. Destruction of government property is a crime. Intent will be important to defense and prosecution. Selective destruction is hard to define as "inadvetant".

Presuming guilt, whether he was acting on his own behalf or for someone else will be of great importance. Commiting a felony on behalf of another after discussion is called conspiracy. That too is a felony with heavy penalties.

It may have been an "honest mistake" if the documents had been inadvertently placed in his briefcase -- but in his FREAKING PANTS AND SOCKS?!!!!!

That my friends, is no "honest mistake"...that is outright premeditated theft.

His "mistake" was in getting caught..

Sandy needs to spend some quality time in a cell with a 300 pound oversexed fudge packer named Bubba....
