Any said "loophole" is superceded by the 5th and 14th amendments to the constitution. Gonzalez had a responsibility to rule accordingly.Uh-oh, it looks like someone hasn't actually read the key plaintiff's argument from Roe v. Wade.
Under common law, this event is a prerequisite to being a "person." Please state your answer in the form of a question.

Well until the Supremes rule that way, we are stuck.Not necessarily. But, then again, it would be difficult to see the President and Congress do what Lincoln was willing to do. Lincoln basically told the SCOTUS to "shove it", and set aside their ruling.
Of course, this in part,led to civil war.

Gonzalez was not only justified in ruling otherwise than he did in Texas, he had a responsibility to.It appears that you feel that the justices, when it comes to an issue such as this, should vote morally. Is this correct?

How about not overturning lower court decisions without cause as Gonzalez and his fellow judges did in Texas?
In regard to parental consent, TWO lower court rulings stated a girl in question did not meet the conditions for a judicial bypass. Yet, Alberto Souter and friends overturned those court decisions and intrepreted and reduced judicial bypass to the lowest possible standard.

I am not saying they should stop teaching about sex,they don't have to be so graphic, and yes I think abstinence will help to stop kids from having sex. There seems to be a notion that sex is fine go to it....

It's a fundamental defect in common law has to be addressed in statutory law.

Ummm ... Gonzales is pro-life.
He refused to make a court ruling that would be overruled by USSC or to be an activist and overrule the legislature.
And the continued whine about Toomey and Specter shows that you are out of touch with party politics - the party machinery does not take down its own incumbents.
