CINCINNATI - A federal appeals court Saturday reversed a lower court's ruling that Ohio voters could cast provisional ballots on Election Day anywhere in the county in which they are registered.
The 6th U.S. Circuit Court of Appeals in Cincinnati ruled that a provisional ballot cast outside a voter's home precinct isn't valid, agreeing with Ohio Secretary of State J. Kenneth Blackwell. Federal law allows people to obtain provisional ballots if they are in the right jurisdiction. Blackwell, a Republican, defines that as a precinct, while Democrats say it's the voter's county.
Ohio Democrats on Saturday night decided not to file an appeal in the case, one of the first major tests of how such ballots will be handled in a close election. They had sued to challenge Blackwell's directive instructing county elections boards not to give ballots to voters who go to the wrong precinct on Election Day and instead to send them to the correct polling place.

It's only the beginning but it's a good start for our guys.
Good news.
Same thing in Michigan.....for now.
More like disenfranchisement of the corrupt, and/or dead.
I heard a report that democrats have already had 23 cased brought to court - the only one they have won is keeping Nader off the Pensylvania ballot. Maybe the judiciary has decided to sidetrack the democrats' plan to foment a Constitutional crisis this time.
Michigan in the same circuit so it will be upheld in Michigan as well.
"This sounds like disenfranchisement of the Stupid."
You are 100%, prezactly correct. If this election is close, we'll have to eat scat because the Scumocrats are too stupid to vote in the right place; and, what is more, too stupid to recognize an intellectual argument recognizing their stupidity, sloth and shiftlessness.
And now I feel better.
I'll tell you what, in Cuyahoga county as you get near Cleveland, half those people barely know what city the live in, let alone where they need to vote.
As well they should be. Perskonally, each voter should have to take and exam and answer 12 questions. Who are your Senators? Name 3 Congressman from your State. Name The President of the United Staes, Vice President, National Security Advisor, Secretary of Defence (War), Secretary of Education, Secretary of the Department of Energy, and Secretary of Health and Human Services.
If you can't answer 9 of twelve answers, then you can go home. No CHADS will be embarrased because YOU ARE TOO SPUPID to engage in the demmmocarcy in this Republic of the United States of America. /rant ~~~ sweating like Gore. Shower time.
The news hasn't said whether we got the full court on this decision or not.......the Dem appointment was a Clin-toon
and Kerrys
This sounds like disenfranchisement of the Stupid.
Man.
Do they have to really do the voting, too?
Or, can they just, like, send someone to do that for 'em?
And disenfranchisement of the cheaters.
It's gonna be interesting to see how many of the 35,000 names on the Undeliverable (by the U.S. Post office) voter cards sent out by the state board of elections turn up as absentee ballot voters.......These are being challenged also in the state by the Attorney General Ashcrofts office so stay tuned........
Now they have to cheat in their own backyard where they should be recognized.
