I'm not as much of a fan of O-Reilly as I used to be but this seems a tad out there. He might have babbled about sex but I don't think all that is stated in that diatribe is on the up and up. Someone may want to take him down.

It was okay for Clinton. Clinton was not a compassionate conservative. Wrong for O'Reilly. They have already linked him to Bush and compassionate conservatism.

That is only a perception. He is not conservative at all. He is a libertarian actually.

There is another reference to the President later in the complaint something like he having friends in high places, all the way to the top, meaning Bush and Cheney. Disgusting.

Truth doesn't matter. Only perception. And they intend to try to fool a few thousand people in FL, MI, MN, NM, WV, etc. that O'REILLY/FOX/BUSH/PASSIONATECONSERVATISM are all the same and O's actions shows their hypocracy. Did you see my earlier posts on the wording in the complaint?

Yes I did see your post, and I also read the entire complaint. It was very political in nature, which ruins her credibility with me, along with the fact that she kept hanging out with him. Sounds like a rat set up to me, and that is true even if he did say all these things!!!

I think this is part of an accumulative succession of small October surprises aimed at portraying so called conservatives as irresponsible blow-hards and wearing away at swing-voters and keeping conservatives away from the poles in disgust.

Those were and are my exact thoughts. And I have grown to greatly dislike O, so much, in fact, that I will no longer watch his program and sent e-mails both to him and Fox stating why.

He judged the Swift Vets without hearing them out. Using BO's own "logic" why wouldn't I simply assume he's guilty as well?

What goes around comes around and usually with a vengeance. Hopefully BO will be off the air soon. I don't care how that comes to be. I just want him gone.

A complaint doesn't need to allege evidence. The Federal Rules of Civil Procedure require only a short, plain statement showing that the plaintiff is entitled to relief, and the complaint is construed at this stage in litigation in the way most beneficial to the plaintiff. This could survive a 12(b)(6) motion for dismissal because it passes this test.

The plaintiff doesn't need to reveal specific evidence in her complaint; the plaintiff and her attorneys need to be able to demonstrate that the pleading is consistent with the information derived from a reasonable inquiry. FRCP 11(b). The plaintiff actually wouldn't want to divulge too much evidence at this stage yet; that will happen during discovery when both sides give each other what they know.

Marlowe will be able to tell you if I paid enough attention in civil procedure.
