Actually you see the direction of improvement.

Up until homeland sec. dpt. Border patrol and the immigration courts were under different departments.

One of the LARGEST problems with "rights groups" is that you do not have to be a laywer to represent people in immigration matters. You can be "recognized" by BCIS (aka INS) and thus do all sorts of michief. Eliminate the non-lawyer rights groups and zap the busybodies are out of business.

I think this needs a two pronged attack. (bear with me this is a bit simplistic) 1. keep further illegal aliens out and 2. deal with those that are here.

1. Keep them out. This means build a border. In some places the rights groups have used environmental impact to prevent fence building. I say exempt border fences from environamental impact law. built a high tech fence.

Allow for instant deportation. DNA sample all those caught. Create permanent blacklists of repeat offenders and exlcude them EVEN IF THEY MARRY A US CITIZEN.

Deputize citizen patrols along the border. They want to help. TRAIN THEM.

Deploy UAV's and USE them.

Provide Border patrol with video cameras so they can provide proof of being shot at.



(I also think the USA needs to pressure mexico to allow US citizens to own land in mexico. SOMEHOW that might help)

2. Dealing with those here: Put overstay final deportation orders on the NCIC. REQUIRE local police to keep illegals in custody. AKA Immigration hold. Since these have already had hearings deport them stat.

Record departures of all visitors, those with no recorded departure also go on the NCIC as overstay warrents. Put them in the deportation system when they get caught for anything from tickets to crimes to applying for a DL.

REQUIRE ALL DMV do a legal status check, if illegal again into the deportation system.

Basically manadate any government interaction require a imigration status check FOR all aplicants. Gradually you will have deportations and legalizations of those here.

#2 is dependent on information sharing. This is what the ACLU opposes.

Hoo, boy, that screams for abuse. I agree - require that they pass the bar, or have the immigrant represent him or her self.

I agree. National security ought to trump, but sadly it legally doesn't.

DNA tests take lots of time, weeks, unfortunately. A fingerprint database of those deported ought to suffice.

I don't think such a Federal mandate on local governments is legally possible. Wasn't there a lawsuit over the Brady Bill which resulted in part of it being overturned because of just such a mandate?

That would be you and me, too. "Papers, please!" For all the weeping and wailing and gnashing of teeth here at FR over national ID, I don't see how it's possible to reconcile opposition to ID with simultaneously requiring it. Heck, some people here don't want hospital ERs to treat patients without the patients providing proof of status. I bet they'd change their tune real quick the first time life-saving treatment is delayed due to a problem with their papers.
