Actually, they're two separate matters. The FEC complaint alleges election law violations by SBVT and has no bearing on the libel accusation. Even if it did, it would make sense to get a finding from FEC before proceding with the libel suit. This would add credibility to the case.
In any case, none of this is going to happen unless Kerry goes smooth off.

In real court. The FEC had already said they'd do nothing
about the 527s before the election anyway. This is all PR.
In the court of public opinion, Kerry weighs each by its
PR value. A libel suit might have more, or at least
additional PR value. If they thought that boat would
float until at least 02 Nov, they'd have launched it.
