Einhorn irked at judge for delay in appeals process (Neo-cons, Chalabi mentioned)

PHILADELPHIA - A former hippie guru convicted in 2002 of a 25-year-old murder wants the judge who presided over his trial to hurry up with an opinion needed to pursue an appeal.

Ira Einhorn, 64, is serving life in prison without parole for the murder of girlfriend Holly Maddux. After two trials and nearly 17 years on the run in Europe, he now is incarcerated at the state prison in Houtzdale.

In a motion sent to the state Superior Court, Einhorn complains that Philadelphia Common Pleas Judge William J. Mazzola has failed to file a response to his lawyer's Nov. 30, 2002, petition outlining his grounds for appeal.

Judges are required to file an opinion defending the conviction.

"He is aggrieved by the length of time this has taken, and I don't blame him, quite frankly," defense lawyer William T. Cannon said Thursday.

Mazzola did not immediately return a telephone message left with his law clerk on Thursday. The judge rejected a similar motion for a new trial soon after Einhorn's October 2002 conviction.

Einhorn plans to appeal on about four issues, including the testimony of two ex-girlfriends who said Einhorn abused them years before Maddux's death, Cannon said. The defense says the allegations are too remote to be relevant to Maddux's death.

Einhorn, who once described himself as a "planetary enzyme," decried censorship, neo-conservatives and the legal system in a rambling letter received Thursday by The Associated Press.

"The outing of Ambassador (Joseph) Wilson's wife, the failure to deeply investigate those firms who made billions of $ on pre-knowledge of 9/11, and the recent disgrace of Ahmad Chalabi are three examples among many that underline how corrupt the system has become," he wrote.

Einhorn also criticized his court-appointed attorney, writing, "Bill Cannon practises McLaw under the auspices of the court who assigns him murder trials galore."

He brings up a good point-in a world run by liberals, a guy could kill his girlfriend suffer not so much as an inconvenience, provided he was a good Democrat and the president of the United States...

I guess turnabout is fairplay-he avoided justice for 17 years. Its not like he is going anywhere, why is so worried about how long its taking..

I have no sympathy for Einhorn whatsoever. He had 17 years of freedom when he should have been rotting in prison, preferably on death row.

Having said that, six months to respond to what appears to be a post-trial seems excessive. Can someone familiar with Pennsylvania criminal procedure shed some light on this?
