It's a permissible reference ~ the guy's picture floated around the public domain too long and in too many places WITHOUT the copyright holder asserting his right.
It can and will be argued that he lost his copyright!
The court in which any suit he files is heard will see the judge send the baliff over to drag him out by his ear.

Well, I agree. It should fall under 'fair use'. But Corbis sent Jim Robinson
a letter complaining about us posting their copyrighted pics on FR. They were threatening big time legal action if we didn't stop.
