Memphis, TN - A Shelby County Grand Jury late Tuesday indicted Shelby County Medical Examiner Dr. O.C. Smith. The charges stem from an investigation into a June 2002 incident in which Dr. Smith was found outside his office early one morning with a bomb strapped to his chest.
The indictment charges Dr. Smith with "Possession of a non-registered destructive device" and with two counts of making "false statements" to Federal Bureau of Alcohol, Tobacco and Firearms investigators.
Shelby County District Attorney General Bill Gibbons says the indictment will have no bearing on the validity of Dr. Smith's expert testimony in trials. Gibbons went on to say he will not rule out the possible use of Dr. Smith in future trials. He said those decisions will be made on a case-by-case basis.
Gibbons noted that Dr. Smith did NOT testify in the case of death row inmate Phillip Workman and that Workman's death sentance was in no way based on testimony by Dr. Smith.
He lied and tried to fool law enforcement, but he would never lie and try to fool a jury?
