I guess he's trying to do that for enemy combatants. That's OK with me.

My foggy recollection is that habeas corpus can only be suspended if the "courts are closed."

There is a law review article on the subject, that is in Google's cache. A section is titled "II. Civil War Military Commissions and Suspension of Habeas Corpus"
