Asking out of ignorance-my question was not a comment on Rush's problems. I just assumed that if a judge ok's it the govt can look at your records.

I believe this is a state judge, and HIPPA is a federal law. Now, I'm asking out of ignorance, can a state judge interpret/disregard federal law?

After this i see no reason for Rush to hold back at all. He should go after the Palm Beach County prosecutor politically, personally and loudly on camera and on the radio waves across America. This Democrat prosecutor gave immunity to blackmailers, drug dealers and liars.

Here's a day that hobbles medical treatment, for people will be even less likely to seek treatments if they are doing something *illegal*! We have trivialized the Law and mocked Liberty and mutual self-respect!

A rotten stench this Judge's ruling has, and fools the court jesters of prosecutors who asked for it!

These people stink. This is indeed a politically motivated attempt to tank Rush. It won't work.

Doctor Shopping is what clinton did when he needed to have an injection of "vitamins" when he first came into office. The WH physician refused to administer any medicine without reviewing the president's records. Clinton refused and found somebody who made the injection.

I don't watch Law and Order much and to be honest-I would not base my knowledge on certain aspects of the law on a television program. But if I do recall medical records in all those programs do get opened once they get a a judge to Ok it.

If that was not the case-thinking logically-a "doctor shopping" law would not exist???

My questions are general in nature and not geared to Rush's problem pre say.

The federal government violated both the doctor and lawyer privacy rights in California 2-3 years ago. I never heard much outrage over it then. Why now?

Have you read HIPPA? I am a lawyer, and HIPPA actually makes it easier for your records to be opened. HIPPA is a POS.

In Florida - there's a constitutional provision or Amendment, I've havn't yet looked up which, regarding the Right to Privacy. Of course, with regard to fedral constitutional law, the "Right to Privacy" is shorthand for the right to stick a scalpel in a baby's head, but that's another story.

First amendment right to free speech - GONE with the SCOTUS ruling that CFR is constitutional.

Second amendment right to bear arms - GONE with the SCOTUS refusing to take the appeal from the 9th Circuit that said we don't have an individual right to bear arms.

Right to Privacy - GONE, unless you're a sodomist.

Before u posted I looked up HIPPA @ http://www.epic.org/privacy/medical/ but I do not see it mention prosecution investigative access being denied. I am probably not reading the thing right I am sure.

The judicial system in PB county is run by purely political liberal, democrat hacks. This is par for the course. The prosecutor does campaign work for democrats in his spare time.
